My father purchased a immovable property of area 300sqds through sale deed in delhi of village abadi area of an unauthorized colony in the year 1967 . He filed a suit for POSSESSION ,PERMANENT AND MANDATORY INJUNCTION IN THE YEAR 1986 against the one occupier claiming for the possession of area of 50SQDS the case was filed at lower court the defendants did not come to any of the hearing in the court while the summons served were denied by them every time sent to them through court at last the summon s were served through publish in news paper but they also did not arrived at last stage of so called case my father expired in the year 1990 none of the legal heirs approached the court as they have been not acknowledge with the fact of case there are on the judgement or the last hearing that was prescribed by court was that the plain tiff is dead and the case is abated or aborted now as I was born in the year 1978 I was brought up by maternal uncle since I was small I had been out of delhi till the year 1994 I have known that there was my property of 300 sqds but was aware of the exact location as my sale deed could not confirm it as the location of the plot was un described now I came to know any how about the case file and recently got the certified copy from the court in the month of October now when I got the exact location of the plot from court papers and site plan I went there at site found that the area has been divided in six parts and houses has been constructed on that now I want to know whether some suit can be file and is the adverse position for me .
