Eviction of tenants
Hi Sir
I have a building in possession having 7 flats, which came in inheritance to my father.
2 sets are lying idle and 2 are in use by us for our family.
There are 3 flats consisting of 3 rooms each and are occupied by very old tenants, who are residing since my grandfather bought this property.
One of these tenants has ceise to occupy this house which is locked for past 11 years and is not paying rent since then. He has his own hotel and his own builiding within the MC area. (Rent per month only Rs 15)
Second tenant is constructing his house outside MC area, but is residing in my house.. (Rent per month is only rs 100)
Third tenant is occupying the house (Rent paid per month Rs 100).
The house is in a very bad condition and the one locked for 10 yrs has its walls and ceiling fallen.. and we dont have any option to get into the locked house.. due to this our even other flats lying on the same floor can’t be repaired.
Finally after several requests, I have filed an eviction petition against all of them on the basis of reconstruction of building and also on the basis of no rent paid by one of the tenants…
Also I have submitted new plan to Municipal corporation for the reconstruction of building, though its going to take lot of time to get the map approved.
Pls guide me further as to what are the chances of getting the building evicted from tenants, and can I also claim the rent and damages from the tenant who ceize to occupy the property without using it for last 10 yrs.
Any guidance, info would be highly appreciated.
