gender biased law of india 1

arnab 19 Oct 2011, 14:59

the law relating to custodial rape is gender biased. here only the rapist have to prove innocense but the woman needs not to prove her rape. if she says that she was raped, her plea will be held as true by the court without any proof. but the defendant(the man) has to prove his innocense with evidence. i don’t get the logic of this law.

another gender biased law is the law of adultery. here also, it is expressed in word that women cannot be held as adulteror. only men will be guilty of adultery. why?

another gender biased law is 498A ipc. here police can arrest men and his relatives without warrant. police needs no proof to issue warrant in this case. why?

there may be many more gender biased law in indian legal repository. i don’t know how many.
