Service agreement issues

Hello all,

I have signed a service agreement with my employer for 2 yrs and Rs.200000. The service conditions that they have mentioned are not satisfied bye them. Company policy says that i can leave company if i’m on probation. But with few recent incidences they have given notice to my colleague who leave the company in just a month.

Please seeking for your advice for what to do in such cases?

Please help me out.

The bond is signed on bond-paper of Rs.200.

I have done the same and I want to leave. I just want to kno. Can I ? Because from what I have heard a service agreement is not valid in India. Rest I don’t kno. Kindly suggest.

It is difficult to conclusively comment upon your situation, without understanding the nature of the Agreement.

Is this purely an employment agreement? Has the company spent an amount for you, for training / overseas deputation etc? - In such cases, the company could require reimbursement of the amount.

You mention that the Company has failed to perform its reciprocal promises, which can be grounds for repudiation of the contract by you.

Additionally note, that if this is a contract purely for restraint of trade ( i.e. for you finding other employment), then such contract is invalid under Indian law.
