Did not got the amount which i have given to buy the flat

Hi
I have given 10 lac rupees to a flat owner in regard to buy the flat. But due to certain circumstances i was not able to eligible for the loan and didn’t got loan for the flat. When I asked for my money the flat owner started ignoring me. The flat owner did not receive my calls as well as not met me personally.
One day the flat owner told me it will take 2-3 months to return my money. But I don’t believe that he will return my money.
Can any one suggest me any legal action regarding this issue.

things which i need to know before i give any advice:-
whether there was a agreement before u gave away the money to builder.
Whether there was any term as to payment or part payment.
Do u have any record of the conversation which u had with the builder later on, where he
said he would return the money shortly.

There is nothing to worry. U need to file a suit for refund of the earnest money that u have paid to the builder…
All u need to prove is that u were denied the laon by the bank on ___ reasons
U r entited to refund of money as u have nt deliberately refused to take possession and comply with the terms of the contract
