A case filed by a Nationalised Bank was dismissed over two months back in Bombay High Court “for want of Prosecution” as no one wes present from the Bank at the final hearing after 19 years from filing. The Bank is not aware of it yet.

But the Documents for the property mortgaged as collateral security are held by the Bank. My questions are:

1. What remedy the Bank has, if any, to revive the suit / recover the claim under the suit?

2. How to approach the Bank to get back the property mortgage documents duly discharged without any payment to the Bank for the Clain in the suit?
