help regarding service agreement..

i need a information regarding comapany service agreement..i signed a company’s service agreement of Rs 3 lakhs for 1 year but i left the company in 5 months. And i have got a legal notice from court regarding this. i havn’t signed agreement on any stamp paper except company’s bond paper. So do i have to pay all 3 lakhs though my package was 2.4 lakhs. Also i heard bonded labour is not allowed in india. Can anyone help me regarding this..thankss…

By signing the Agreement as per appoinment letter You have entered into a contractual relationship regarding your service with the company. You and Company are binding by the provisions of Indian Contract Act. You are bound by the agreement voluntarily signed by You. here there arise no case of bonded labour. My opinion shall be, Appoint a Lawyer for You to defend You, otherwise ex-parte decree may be passed against You by the court
i have read the Indian Contract Act on the internet but this law states that the agreement should be in written, stamped and registered. but i my case i havn’t signed any stamp paper.
can you please tell me more on this..

A service agreement not necessarily required to be stamped. Your employer made an offer of employment to You as per the terms and conditions mentioned in the appointment letter and you have accepted the offer by signing on the appointment letter and delivering the xerox copies of appointment letter signed by you and submitted joining letter to join the post which means you have voluntarily accepted the offer of employment. Here the contractual relations arie. Your point of “non stamping of contract letter” may be raised as your defence in the court by your Lawyer. lets hope for the best
