Family dispute over sale of flat.
Hi , can anyone help me with my query.
i live with my husband and 2 children. My husband has 3 sisters and 4 brothers i.e total 8 siblings and he is the last brother among them. All the other siblings married and started staying separately. As per my father-in-law’s WILL, my husband was the nominee to the house where we stay and all the other siblings gave their NOC to it. My father-in-law expired 8 years back and we are staying in this house till date. Now we want to sell this house and buy a bigger house. My 2 brother-in-laws are also looking for a house in mumbai.
Is there any chance that any of the sibling can show a right on this property or bring a stay on the sale of this property? Do they have a right to demand a share in the sale proceeds of this flat? Can they challenge us in court? Please give us a solution/ advice. Thank you

On the death of ur father in law, the “Will” made by him has to be probated. and ur father in law can bequeath it as he desires, only when the house has been acquired through his self earned money. then the siblings of ur husband does not have any right over the property. if its an ancestral property they too have right over the property.
check ur NOC wheather it is for your residance purpose or power of attorny types…or u send your NOC to

My husband is staying in a old ”Rental House” which is in my father in laws name since his birth in 1950 .My husband has 2 brothers and 3 sisters.We shifted into another house for a short period of 10 years due to family discontent,however returned back to take of my mother in law untill her death in 1996. Brothers n sisters were staying away seperately with their families.After the death of my mother in law we continued to stay in the same house until today. Now I want us to sell the house
Question
1.If we sell the house what is the ammount to be paid to the landlord for the transfer of the flat.
2.are the 2 brother and 3 sistes entiteled to the share in the ammount received due to sale.
3.If we surrender the flat to the landlord do we need the permission of the brothers n sisters.
5.We have maitained the flat by getting repairs done regularly and renovated with the permission of the landlord, can we claim the maitainance nad the ammount used for the renovation if we need to share the ammount received with these family members.
