Tackling Investment Laws

I just graduated over the summer, and after taking a good 5 month break, i am now in the process of sending out my CV to a few law firms in Bangalore. Since i’m looking for transactional work, I was advised by a friend to not only brush up on my company law, but to also try and internalize certain aspects of Investment Laws in India.

Just wanted to know if anyone had advice on how i should go about tackling the Foreign Exchange Management Act. Are there certain parts that i need to pay special attention to? Is there any method of management that would help me understand it better?

Also, how do i go about understanding the numerous SEBI regulations? And what would be a good source to find them?

It would be great if anyone had links to blogs or posts where important aspects of Investment Laws are discussed.

It would depend on how much knowledge on FEMA, FERA, SEBI, RBI etc. you already have. If you have a very good background then you are definitely ready for a law firm.

If you feel you are yet raw then here is a good piece of advice. You say that you are looking for a job meaning that you have not yet been recruited via campuses. Use this to your advantage. Instead of joining a law firm, there are many leading individual practitioners/ counsels in the above areas i.e. FEMA, FERA, SEBI, RBI etc. who might take you. Of course they will pay you only a measly stipend but after working with them for a year or two any good law firm/ corporate/ bank will easily pick you up.

I know many of my friends who have started out this way and are more knowledgeable and confident than their contemporaries who received plump PPOs.

Thanks Sushant. That’s something for me to ponder over.

I’ll admit i dont know much about Investment Laws. It wasn’t a subject that i studied in college, and i’m only dealing with it at a basic level for my MBL course from NLSIU. Its something i’ve had to consider as a ‘groundwork’ of sorts to get the right job at a certain law firm.

To be honest, if i had to work with a counsel, there are other areas that enthuse me, but i’ve consciously chosen to go with transactional law at a good firm. So if you’ve got any advice on how i should go about strengthening my understanding of Investment Laws in the next few weeks, that would be very helpful.

Read FEMA along with the consolidated FDI Policy which is going to be reviewed in every six months by the RBI. I have uploaded one for you. Find that out attached.
