Factory paper lost.. 1982.. Non registered documents

Legal Experts… Please help me know…

My father bought a property in 1981-82.. and he expired in 1992.. I now realize that the original share certificate is not the only document which proves that the person is the owner of the property. The original agreement copy is not with us. Nor the society has those papers. we dont even know, where is the first builder.. and who was owing this property before my dad bought it. As it was bought in 1982 it is not even registered. Please advice..

How do i get the original copy made? i heard from a friend that we can sell it to our mom, internally.. (as this property is now with 3 of us.. my bro, mom and myself).. Please advise. Its urgent.. as they are planning to go under redevelopment, i may not get any hold of my property as there are no papers.. :(

Dear Geeta,

There are many questions coming out from your facts which you shall reveal.

Society is not having original papers, right? Not even copies?

What are the documents available right now with the society? That’s an important question. Society was formed by whom? Must been BUILDER. Find that, Members of society shall tell.

Three with us and sell to mom? Kindly clarify this statement.

As there is already more than 20 years, LIMITATION ACT will come in picture and no 3rd party can claim the ownership. If he/she claims, he will need the papers as well which is nit possible.

Its a confused situation. Ask society for other papers, find builder. The problem is its not registered. Limitation Act will help you and try to find owners of the property (ex-owner) and discuss the same.

Only society can help you in this regard, as they are formed legally, they HAVE TO TELL. If you have the copy (non-registred one) relax as no one can claim as more than 20 years has gone.
