Shop on Rent

sarfraz 25 Sept 2010, 08:06

Dear All;

We have two shops at the ground floor of our residence. These shops are given on rent by my late grandfather long ago(around 35 years back).

last year we renovate the complete building including the shops and we gave back the shops to the tenants but we asked them to give us rent equivalent to current conditions but they are not agreeing to give the new rent so we didnt renew the contract.

Now we dont want to continue with these tenants and we need to vacant the shop.

can anyone tell me the procedure I need to follow to vaccate these shops

what legal process we need to follow and how long will it take

Thanks and Regards

Sarfi

hi,

yeah, u can very well file a suit for eviction if the term mentioned in deed has ended and you don’t want to renew the contract. if u r frm UP than eviction suit can be filed under sec 21 of UP rent control act and if u’re frm any other state then check for simultaneous provision.

In case u want to continue ur contract and want to increase the rent than again fr this too a suit can b filed under the above act but there exist certain predetermined rent rates so u can’t exceed tht!!

i guess these r the options available to you.

gud luck!!!
