home property papers are lost.pls help me friends

Hii dear friends m khavij from new delhi

my home properties paper has been lost.can i get the new papers from government again?what is the procedure and cost?what all are the documents i need to submit?

please help me.

Same happened to me also. I lost the allotment letter,installment payment receipts,power of attorney and sale letter of my house. Kindly share the steps to be taken under this circumstance.

Dear Khavji/Jaya,

Which kind of papers you have lost. If you have lost/misplaced Encumbrance certificate,Khata Certificate, Mutation Registrar, etc then you can apply to the revenue officer and collect the same. But if you have lost the originals sale deeds and old title deeds then apply for a certified copy.You will get it.

Also but for a good title on your land, file a police complaint and then go for a public notice in 1 english newspaper and 1 local newspaper. In future, whenever you will go for any land transactions, you can show the police complaint, public notice, certified copy of deeds for your genuine intention.

Regarding allotement letter and receipts, dont worry. ask your builder to provide you the copy of the same. They will provide.

Just remember for registered documents, you can always get certified copy.

I am no expert but i believe that since you registered your immovable property with the sub-registrars office in your district, his office obviously has the records like the sale deed, poa etc. I believe you may have to approach the sub-registrars office.

Dear Gyan Sir,

Many many thanks for your kind response. I lost the allotment letter from Noida authority, power of attorney and sale letter by the original allottee along with the payment receipt of installments. By my bad luck the sale letter/ power of attorney was not registered. I took out the file in order to proceed for registering the property with Noida authority. I will register FIR and will put ad as you advised and then will look for the help of an advocate and Noida authority. Kindly share your valuable suggestions.

Dear Jaya,

I am not a sir..hehe I am just 2 and half years experienced in legal field. Its just I am in real estate so little easy to reply.

As you told me it was through noida authority but not registered so they cant provide you directly. You have to file it under RTI Act and then they will have to provide you the certified copy of those documents.

Also, file police complaint & Public notice. Dont worry!!

First, file a police complaint and then go for a public notice in 1 English newspaper and 1 local newspaper. Now,in case, you have lost documents like Khata Certificate, Mutation Registrar, etc then you can apply to the revenue officer and collect the same. But if you have lost the originals sale deeds and old title deeds then apply for a certified copy. And also, ask your builder to provide you the copy of allotment, receipts and letters. I am sure it must be sounding a very complicated task to you. Believe me..it is indeed quite complicated as I’ve been through similar situation. I really had a tough time getting duplicate copy and was wishing for some service that would have managed my documents. Hey, You know what..i just came across this page on facebook ‘clip to click’, where members were discussing about launch of some service that would provide facility of individual document management.

Hi Gyan,

There is slight difference in my case here if you can help.

i just bought a Flat, But seller needs to keep the original copy of his old agreement and wants to provide me with True Copy of the Agreement.

Beacuse his old agrement consists of another flat. So when he will want to sell another flat on the same agreement , he would need the original agreement.

what should I do ?

If I accept the tru Copy , Will I be in any disadvantage ?

I have a similar problem, due to constant moving around and transfers the property document have been lost. We checked if we could get it in the Haveli, however it is not available . This property is over 20 yrs old. Does this mean I can never sell this house??? Is there another way around this. This property is located in Pune

Dear Khavij, The procedure to be followed in case of loss of papers is as follows:[/b]

1 File an FIR

Before applying for duplicate papers, a person should primarily file a police compliant regarding his/her lost, stolen or missing original property papers and obtain the complaint copy for future reference. An FIR should also be filed if a bank misplaces documents in relation with mortgaged property. If you are a buyer, it is your legal right to ask for related property papers from your seller.

2 Publish an Advertisement

In addition to filing an FIR, a home owner needs to publish an advertisement regarding lost or missing property papers in local and English newspapers. Likewise, a buyer can also put up an advertisement, asking the claimant of the property to contact him/her regarding the property papers, but within 15 days of the published advertisement.

3 Property Registration

A house owner, on the basis of the FIR, also has the option to apply for a duplicate share certificate from the housing society. Subsequent to this, the housing society can share this certificate application in the society meeting. A positive consensus on this matter can lead to the issuance of a duplicate share certificate to the owner, after the payment of a certain fee. NOC is another important document that both the home owner and buyer are required to possess. In the absence of this document, it will be difficult for the buyer to get a home loan from banks/lenders. Subsequent to the above procedures, a home owner needs to get an undertaking regarding his lost/missing original property papers on stamp paper. The undertaking should include property details, FIR number and a version of the published newspaper advertisement, along with a letter confirming that all the details given in the undertaking are correct. The owner should get this undertaking registered, attested as well as notarized by an attorney.

4 Procuring Duplicate Copy of Original Sale Deed

A registrar’s office maintains the archives of all property transactions in its authority. To procure a duplicate copy of the original sale deed, an owner has to visit the registrar’s office. For procurement, the owner has to submit police complaint copies, the newspaper advertisement, share certificate obtained from the housing society, and also pay relevant charges. Upon this, a copy of the original sale deed will be given to the owner.In case the property is old, it is highly recommended that one obtain a title report of the property document from the deputy registrar’s office to confirm that the said property is hindrance-free. Dear friends we have purchased a flat when we purchased flat building was having only 5. Floor after that the got approval for 7th. Story building the society had alloted us 501 and after the have rieased 2 more floor they have asked us to pay duty on 603 but they didn’t given us allotment letter and we have paid the stampduty also now they are nt giving us changed allotment letter so plz help by giving your valuable advice

I have bought a property of 150sq.yds of Rs.6lakhs by paying Rs.2Lakhs advance which is printed in bond paper and later I have paid the vendor Rs. 2lakhs for which he dint give us a complete bond paper, instead he wrote Rs.4lakhs paid and signed at the back side of the bond paper. Now after a month the vendor ran away. I went to police station but S.I. is not ready to book a case on him. It was my hard earned money and now I have nothing left in bank. Please help me out of this problem.

There is always a solution in the field of property.

It depends which documents are missing and the time period of those documents. Best way is whatever the documents, you have got, give the same to your lawyer. He will give you title report or ask for further documents.

There are always certified copy of the deeds. Now a days mostly all revenue offices have scanned and you can contact the concerned revenue office.

If not available then it means these are very old documents and in such scenario, go for public notice in the newspaper with police file and accordingly, bank will approve subject to your own eligibility.

Try LICHFL, HDFC. They give loans easily;)

Further, you can execute confirmation deed with Indemnity from the owner and accordingly, try.

All banks have lawyers too so you can discuss with them.

Above advise is given for plots only. If with a builder then things will change, little bit.
