Hi - what do you mean by “hard work” exactly? It sounds like both were earning money for the household? Did both father and mother pay for the house or make significant investments in the house, or was the property exclusively in the father’s name? Was the property acquired before marriage? It seems like a potentially complicated where a lot of different facts and specifics might come into play, according to this and other articles online: https://timesofindia.indiatimes.com/india/why-we-need-a-fair-law-on-marital-property/articleshow/60820963.cms

It is possible the mother may also have rights in the house, but it might not be easy to enforce, so you should consult with an actual lawyer in person to protect your mother’s position.

If any family lawyers on this forum can shed some light on this, please do share any thoughts.

After the marriage of mother and father, the father starts a business with mother gold. And they both did work in that business. Mother taking care of children and taking care of business at home. Simultaneously they grow very well in their life. Father purchased many places and business-related things. But due to a few issues father not taking care of the family. Now, what mother can do? Now my question 1. Is that all the properties and those businesses things belong to only father or mother also. Son also almost 12 years works with father in that business. 2. Father can give that all properties to anyone, Mother and Son don’t have any right on that?
