Vikas Bhadauria drops bombs about BCI chairman Manan Kumar Mishra’s modus operandi, highlighting some of his greatest recent hits.

The Press Releases of the Chairman of the Bar Council of India, Manan Kumar Mishra, follow a common pattern –they are always aimed at stifling genuine criticism, and stalling reforms. With a series of ad-hominem attacks and labelling, the BCI Chairman ensures that any space for dialogue, introspection and critical analysis is erased. … It seems Mr Mishra has made inconsistency a badge. In Mr.Mishra, one sees a worshiper of power figures, lover of status-quo and hater of individual liberties. He has been using his office to show subservience to his political political ideology. Irony dies a several deaths when such a person points fingers at others for ‘politicizing’ the bar. It is unfortunate that by reducing the post of BCI Chairman to that of a courtier singing paeans to the system, he has squandered the opportunity to usher in proper institutional reforms which the legal profession badly need .

“It is appalling to note that “Live Law” has allowed its platform to be used for a defamatory story prompted by ill-will and malice to make personal allegations against Mr. Manan Kumar Mishra, Chairman, Bar Council of India”, said a press release issued by BCI. “Mr. Manan Kumar Mishra, Chairman, Bar Council of India has never misused his position for any personal political benefit”, asserted the BCI. … BCI said that it has resolved to “make a complaint to the Ministry of Information and Broadcasting against the author Mr. Vikas Bhadauria and the news portal “Live Law” for their acts of misreporting, omission and commission, which are nothing short of yellow journalism and a scar on ideal and honest activities of the Media/Press”. “The said author has done cherry picking to suit his false story and has made reference to selective portions of certain statements and communications of Mr. Manan Kumar Mishra without giving full text and proper purport which has always been to advance the cause of the bar. The story by Mr. Vikas Bhadauria is only scandal mongering and vilification campaign against Mr. Manan Kumar Mishra and we resolve to condemn and reject it with all contempt it deserves”.

Mr. Manan Kumar Mishra was elected Chairman of Bar Council of India, he has been relentlessly espousing and fighting for the cause of Advocates’ fraternity in the country. The Members would like to place on record that Mr. Manan Kumar Mishra has been unanimously elected Chairman of the Bar Council of India for the 5th consecutive term on 06.12.2019, because of his quality of dynamic leadership and commitment for the cause of Bar and Standard of Legal Education. He has always fought from the front for the cause of Advocates with all Members of Bar Council of India unitedly standing behind him. There is no difference or dissension among Members of Bar Council of India as regards the laudable acts done and being done by the Chairman for promotion of a strong, vibrant and independent Bar and Judiciary.

Manan Kumar Mishra is a man on a mission, if his past and present conduct and utterances are anything to go by. Unfortunately, the position he presently holds, Chairman Bar Council of India, (BCI), gives his pronouncements the semblance of authority, emanating from his office. He, therefore, presumes he can portray to the public that he and the BCI speak on behalf of the entire legal profession. Nothing is further from the truth. The BCI is a statutory body constituted under the Advocates Act,1961. It has well-defined, limited jurisdiction, which it legally cannot transgress. Each state also has its Bar Council, with limited jurisdiction. The press release issued by Mishra on May 30 on behalf of the BCI constitutes a clear transgression of its jurisdiction. It is an unwarranted assault on the independence of the legal profession, as also an illegal attempt to interfere with the fundamental right of free speech, thought and expression, guaranteed under Article 19(1)(a) of the Constitution. It is also an indirect attack on the press, on NGOs, activists and social workers, who were constrained to repeatedly bring to the attention of the Supreme Court the horrifying plight of millions of migrants.

Manan Mishra just keeps getting worse. He is like Donald Trump before Donald Trump was cool. Extremely insecure, extremely thin-skinned, and with a tiny little bit of power he balloons in self importance and obnoxiousness. The BCI has been a joke under him and the profession has not gone anywhere good under his tenure but if anything it has regressed.
