SC asks gov response on National Court of Appeal writ to ease apex appellate flood

The Supreme Court asked the law ministry and central government on Friday about establishing a national court of appeal to hear certain appeals from the high courts instead of the Supreme Court, after a writ petition was filed by a Kerala advocate, reported PTI.

V Vasantha Kumar from Puducherry has been pushing since November 2013 to consider the Supreme Court’s 1986 suggestions to insert into the judicial hierarchy a National Court of Appeal with benches in several cities.

National Court of Appeal is not anywhere found in the Constitution of India and without an constitutional amendment, the present litigation cannot usurp the powers of Parliament.

There are far more fundamental reasons for the appellate flood. Adding one more judicial forum would only be a Lawyer's delight, but a Jurist's despair.
