Janhavi Gadkar bail plea deferred 2 days as victim's daughter files IA

The bail plea of Reliance Industries in-house lawyer Janhavi Gadkar, who allegedly killed two while driving drunk last week Tuesday, has been postponed to Wednesday by a metropolitan magistrate yesterday (Monday), after her lawyer Mahesh Sabnis said she needed urgent medical care to tend to her fractured hand, reported the Hindustan Times.

The Times of India reported that Sabnis’ bail plea, which the paper had seen, argued that “the facts are blown out of proportion” and that the police acted in an “overzealous manner”, mechanically applying culpable homicide under section 304-II of the IPC, when section 304(A) - causing death by a rash or negligent act - which carries a two-year maximum jail term, should apply.

The bail plea also argued that she comes from a “respectable family” and that she would continue to cooperate with the police.

The police resisted her bail plea because they said they had enough evidence to prove the charge of culpable homicide not amounting to murder, and that only a sessions court could try the offence so a magistrate could not grant her bail. They also said that she would tamper with evidence and influence witnesses if she was released on bail.

The daughter of Salim Sabuwala, of one of the two men killed in the accident, had filed an intervention application requesting to be heard via her advocate Subadha Khot, who said according to the HT: “We are the aggrieved party and have suffered a lot. We have pleaded in the application that the investigation is still incomplete, and that we should get a hearing before the order is passed.”

Nouman Sabuwala, the son who was also injured in the crash, has called for her case to be non-bailable because it would be another shock to the family if she were released, reported Mid Day.

Alok Agarwal, the chief financial officer (CFO) of Reliance Industries was summoned to give evidence to the police, according to a stock exchange filing by the company. He reportedly told the police that he had shared a pitcher of beer with Gadkar shortly before the accident until around 1230am.
