AAP alleges ‘emergency’: Law minister Tomar ‘detained’ not ‘arrested’ for a few hours ‘in regard to Delhi bar council complaint’, says cop [UPDATE-3]

IANS reported:

Delhi Law Minister was detained on Tuesday in a case relating to an alleged law degree, police said. An AAP leader, however, said the minister was arrested.

"Tomar has been detained and not arrested. This is in regard to the complaint by the Bar Council of Delhi in connection to the alleged fake law degree and enrolling himself as an advocate," a police officer told IANS and added that he will be released in a few hours.

Delhi Police chief B.S. Bassi said he didn't know anything about it as he was in a meeting.

The minister was taken to the Hauz Khas Police Station.

Aam Aadmi Party leader Sanjay Singh, however, tweeted that the Delhi Police has arrested the minister without any notice or prior information.

Tomar told CNN-IBN that that he didn't know why he was arrested.

"Around 30-40 policemen asked me to accompany me to the police station without any prior notice," he said.

Tomar alleged that this was being done to tarnish the image of the Aam Aadmi Party (AAP).

Two cases are pending against Tomar in the high court, alleging that he had enrolled himself as an advocate on the basis of a "fake and bogus" graduation degree while the other plea sought cancellation of his election.

Bihar's Tilak Manjhi Bhagalpur University, from where Tomar claimed to have obtained his law degree, had earlier told the court that the provisional certificate is not "genuine" and the document "does not exist in the university's record".

The serial number of the provisional certificate in the record showed the name of another person and not that of Tomar, said the university.

In a 28 May report the university exonerated Tomar as having been enrolled but under another serial number than the one that was requested, as tweeted by Dushyant K. Mahant @DKMahant:

Meanwhile, the AAP government is making hay from the issue accusing the central government and Lt Governor of totalitarian behaviour, according to IANS:

Delhi's AAP government on Tuesday accused Lt. Governor Najeeb Jung of unleashing an "Emergency-like situation" after its Law Minister Jitender Singh Tomar was arrested amid high drama over an alleged fake degree.

Deputy Chief Minister Manish Sisodia told the media that vested interests were ganging up against the AAP government because of its anti-corruption campaign but vowed that the Aam Aadmi Party (AAP) won't be cowed.

Sisodia said although the issue of Tomar's alleged fake degree was in the court, about 40 police personnel swooped on Tomar's office and took him away as if he was a fugitive.

Delhi Police does not report to the AAP government but to the Lt. Governor and the union home ministry.

"The police told Tomar they had come to see some documents... They asked him to accompany them to his house. On the way they told his driver to get off and took charge of his vehicle and told him he was being detained.

"They told Tomar that he could ask someone to bring the documents to the police station...

"What is going on?" asked a livid Sisodia. "Was he (Tomar) running away? Did he explode bombs in Delhi? There is an allegation (against him). The matter is in the court. What was the need to arrest him?"

Sisodia added: "There is something wrong... This arrest is illegal. There is an Emergency-like situation. This is supposed to be a democracy... Maybe it is an attempt to teach the AAP a lesson (for what we are doing)."

As it happened…

Aam Aadmi Party (AAP) Delhi law minister Jitender Singh Tomar has been arrested, according to a number of reports.

The first came from Sanjay Singh AAP @SanjayAzadSln:

मंत्री जितन्द्र तोमर से बात हुई बगैर किसी नोटिस या पूर्व सूचना के दिल्ली पुलिस ने उन्हें गिरफ्तार कर लिया हौज खास थाने ले जाया जा रहा है

News channels quickly picked it up thereafter.

Hindustan Times correspondent Avantika Mehta @bitingfriends tweeted:

Tomar's lawyer Rajiv Khosla says he has been called to PS; says minister's charged with forgery and cheating.

HT assistant editor prawesh lama @LamaPrawesh added:

Police filed FIR against #AAP Minister Tomar last night under sections 420, 120B 467, 468 IPC. @htTweets #fakedegree

khushant @khushant4 tweeted:

Tomar has been in trouble over his allegedly fake degree certificate, with the Bar Council of Delhi having started an inquiry into him.

Tomar’s predecessor, Adv. Somnath Bharti @attorneybharti has now weighed in too, blaming Narendra Modi:

Shocked to learn the news of arrest of Sri Tomar. There cant be a proof better than this of dictatorial approach of @PMOIndia. Emergency??
