Indian Courts mechanically remand arrestees to 15 days to judicial custody and often extend the custody for no rhyme or reason. What is this sanctity of 15 days? Why not just 2 days, 5 days, 7 days or 10 days? It is nothing but a colonial vestige of the moribund, convoluted criminal system which seeks to punish at the beginning itself without establishing the guilt. Incarceration at the drop of a hat even for routine street-corner squabbles is the dark delight of the Indian Penal System originally devised by the colonial britishers to keep the restive Indians in check. If a person is not going to be interrogated in judicial custody and is going to be enlarged on bail sooner than later, why send him to jail for 15 days? Why cram crowded prisons with such needless judicial custody?
