High Court OKs bar council member’s hereditary succession

The Delhi High Court has upheld the appointment of the son of late Delhi Bar Council chairman K K Sareen following controversy and the writ petition over hereditary succession.

A bench led by chief justice Dipak Mishra held that the state bar council’s co-option method of selection of a member without re-election was well within its own rules and constitutional as it happened with the concurrence of a majority of the members, reported the Indian Express today.

KK Sareen passed away in August of last year and his son Aman Sareen was appointed after a vote of the members. This was challenged by Advocate D K Sharma who was the 26th most popular candidate in the 2009 Delhi Bar Council elections, only barely having missed a seat on the 25-member council.

Sharma had filed a writ petition to challenge Aman Sareen’s appointment, as reported by Legally India in August 2010.
