Akhil Sibal in Crocs India claim that its shoe design infringed by Bata, Relaxo

The Delhi high court heard first arguments on Monday in the infringement claim by the US footwear company against two Indian rivals that have released similar plastic clog-style shoes.

Calling it a case of obvious imitation, Akhil Sibal, […] counsel representing Crocs India said, “I am in the market since 2004 and have a formidable reputation in the market. Uniqueness of the product which is the selling point of the product is the look of the product.”

So, what's noteworthy about this case and the stage of litigation it is in, legally! Kian?

You don't think it's a fun case?

Kian. Not the first of its kind for sure. There is already a case of this kind involving tread pattern wherein ex-parte interim injunction has been granted by Justice Nazmi Waziri a few days ago.

Fair enough. Though this is a big consumer brand and Crocs are a really ugly global brand, so I maintain it's quite a fun case. :)

Kian, this is very disappointing. How can you indulge in such lookism?!

Contrary to what those old FB groups say, you can wear crocs and not look like a dumbass.

They have different styles and designs now, including formal Crocs footwear. It is an innocuous, cute brand with comfy shoes.

They're beautiful inside and out. Stop calling them ugly.

Ugly global brand indeed. Mph

and of course, free publicity for the lawyer in question :-) Is he really a senior counsel or is there another layer of passing off in a passing off action?
