He meant awful. Why should citizenship be selectively given based on religion is the first question. The second is that they did a very shoddy job with the rules, leaving tons of ambiguity in it, which is now hindering even their own populist purposes before the election.
It's not about "why they should" but "whether they can." And, if they can then morality has no place here.
Morality always has a place. Those who deem that it doesn't will always be separated and remembered by history.
That's is not for the courts to decide. If it's legally correct then anyone's moral stance is of no relevance.
"Morality always has a place. Those who deem that it doesn't will always be separated and remembered by history."- My new favorite line.
Kindly also refer to the interview given by the FS, wherein he mentioned specific US enactments that fast-tracked citizenship processes for Ukrainian Jews/Ukrainians fleeing Communist Russia/USSR, Hungarians (when USSR and allies sent in tanks to crush the revolution), Cubans et al.

Contrast this with how the US abandoned its "native" allies in Afghanistan, Iran, Iraq and Syria. Only the extremely fortunate and connected were able to get out and in minuscule numbers.

Not directly connected. But please read the book titled the "Blood Telegram". Whatever Nixon/Kissinger did was never undone by successive administrations.
This is whataboutery of the highest level. Sad, but not surprising, to see that the Right is using utter ignorance of history, and the failings of other states, to build a legal and moral house of cards.

First HS, then FS. I don't know if they are cynical power grabbers, or what sociologists call "Useful Idiots" (it's a specific term, not an insult. look it up)
True story. I took an Uber yesterday in Kolkata. The driver was a Hindu from Bangladesh. He said that he came to India after the Babri Masjid demolition, as many temples were destroyed in Bangladesh as revenge and he himself was threatened with his life. He said that the CAA makes no difference to people like him, as he already has citizenship documents like Aadhar. His previous generation fled during the 1971 war, when Indira Gandhi was in power and the Congress ruled Bengal, and they got citizenship as well, via ration cards. The generation before that fled during partition, in 1947. So, he said that the CAA will only benefit a small number of Hindus who fled this century and haven’t managed documents for some reason. But he said that the CAA is still being welcomed by people from his community (ie erstwhile Bangladeshi Hindus, now Indian Hindus) because of its sentimental value, to acknowledge the persecution they have faced. Plus, by certain other Hindus (not from Bangladesh) who are unhappy with Muslim immigration from Bangladesh into Bengal (or who dislike Muslims generally) and are happy that the CAA excludes Muslims. He said that the BJP is relying on this sentiment to increase its vote share in Bengal, rather than tangible benefits of citizenship (which is a bit of an eyewash). According to him the BJP will get more seats than the TMC this time (which Prashant Kishore has also predicted).
I watched this in full. If a first year student made these arguments in a moot court, they would be laughed out of court.

Salve is making specious arguments only to give his political masters some fig leaf of respectability. His main job is to muddy the waters, so people will think "Oh, the great Salve has spoken, our government is doing things correctly".

Everyone who has bothered to educate themselves about this topic already knows the issues. They tried to exclude people in Assam from the list of citizens, and found that they were also excluding their own vote bank. CAA is nothing but an excuse to say "we are using different standards for our vote bank when considering them as citizens".

It's good that Salve has made these arguments publicly. History will judge. History will remember. And history will not be kind to Salve.
The mainstream Delhi media keeps referring to Pakistan while discussing the CAA, but the spotlight should be on West Bengal and Bangladesh, because that is the root cause of the CAA. The religious demography of many areas in West Bengal has changed in favour of Muslims because of unchecked influx of people from Bangladesh and Myanmar. There is an undercurrent of anger among the people. I am just telling you the facts. Even someone as liberal and left-leaning as Atishi Marlena made controversial remarks against Bangladeshi and Rohingya Muslims.

Forget Salve and Abhinav Chandrachud. It’s in villages in Bengal where the CAA is playing a role .
all those downvotes just show the intellectual capacity of those liberals who oppose CAA and ask for alleged minorities to be added
What's to stop them from using the existing older citizenship rules? If Muslims from other countries can use those same rules to get citizenship, then why not people from other religion?
Can someone explain why NLUs are so silent about CAA??? 4 years ago NLUs protested in the streets and one NLU banned the present Vice President of India (then a Governor) from campus. Why the silence now??
Tier 1 NLU here, most people are apolitical. Especially lockdown batches.
Why marked trollish?

Nothing wrong

all thoes self intellectuals dont understand that when we also start importing muslims who themself are radical and persecute Buddhists Christians Hindus in Islamic countries will create communal violence in this country. Just see the recent cases in last few years.

I have already seen them asking for muslim lgbtqs in caa
Like Wtf
Muslims cannot be LGBTQ and LGBTQ cannot be muslims
In the first link since the start of 4th minute, you see how Salve makes increasing illogical and agenda based arguments. Any lawyer or even a law student can see through such stupid arguments.

I'm appalled that this is considered as "great and valid defences".

Salve embarrassed himself in the SC during EB hearings he did the same in this interview.
