Guys clerkage is an old school term used for administrative costs. It goes for the running of the office, while the fees are the remuneration of the lawyer themselves. It covers clerk salaries, junior salaries, office running costs. Some have done away with it by simply keeping their fee high and not creating a bifurcation. Don’t be obtuse.

Clerkage is charged at the time of filing. The payment is made directly to the clerk. It includes everything from mere tying of the matter, to removal of objections. Getting pages typed, if illegible/ handwritten. Getting papers from the department- this includes HAVING to take 'care' of the department peons. Imagine if your stay is running out, matter is due to be listed, but suddenly your papers are not traceable. The clerkage will look like a small amount on closer inspection.

Matters are dismissed for non-removal. If some persons are finding it obnoxious to pay clerkage fees, just consider the restoration expenses. This is a whole fresh application for which your Advocate, whether the same person, or a new one, will charge you afresh. Also yes, again pay clerkage. No clerk is going to work for free.

A good number of filing clerks themselves work WITH (important word, 'with', not FOR) numerous Advocates.

Clerkage fees are NOT junior's fees. These are charges paid to a separate individual who is needed to do almost everything possible to ensure your matter reaches the court, for listing, at least.

He's scamming you. All this nonsense prevails in delhi and Bombay. I've seen third class lawyers from amity who are unable to even plead properly in court demand lakhs in fees. Delhi lawyers are the most untrustworthy kind you'll ever meet. They even demand 50% of settlement amount in divorce and medical negligence cases. I was a junior to a big time senior at Delhi and but he didn't scammed clients like this. Clerks at his chamber used to charge decent sum for filing on their own. It was clear that the clients had to pay 3.3 lakh per appearance and that's it, no more futher charges. I would advise you to confront him about it.

Its just another way in which you are scammed to pay more fees. Ideally the clerkage amount should go to the clerk(s) but it does not. Imagine a Senior who charges 10 lakhs per appearance. Has 10 appearances a day. Thats a Crore. Now@10% clerkage the amount supposedly "going" to the clerk is...... multiple by 20 even.... man thats one rich clerk.
