The most important court case of the decade and will now be taught and debated in our law schools too. But the big question to ask is whether India should follow suit and have only income-based quotas and not caste-based quotas?
BREAKING: SCOTUS decision nullifying affirmative action can be subverted easily!
Just watching CNN now. Apparently a student can still write an SOP discussing their experiences being black. Then this means โฎโฎโฎ colleges can easily subvert the ruling!
It's important to note that this decision was about race being a factor in admission proceedings. The SCOTUS had rejected race based quotas long ago. This ruling further narrowed how race could be looked at in admissions processes (although it did not hold that race could not be looked at at all).
Anyway, US affirmative action jurisprudence is going to have no impact on India. The battle against reservation in education institutes (both private and government) has been lost. The battle for only caste based quotas has been lost. The battle for 50 percent limit has been lost. The new battleground is going to be reservation in private jobs (initially blue collar but also white collar in time). I have little doubt that that battle will also be lost. The only trend for reservation in India in the near future is onwards and upwards.
Horrible and partisan judgement. Even for the supporters of the SCOTUS majority opinion, this ruling does not change the casteist nature of the Indian society. Reservations are here, and here to stay. Savarnas, deal with it after being privileged for thousands of years.
Sorry what anyone's forefathers did or any benefits accrued should not be used to punish posterity. This statement reeks of contempt and seeing so many upvotes to it is disgusting. Your statement "DEAL WITH IT" cause some of your forefathers were in the wrong is the same school of thought that would say punish a son for murder committed by father or worse rape the daughter of the rapist (the kind of justice you can see in lawless areas of Pakistan). There is no denying that reservation system in India is attrocious and unethical. As long as it is used for non-creamy first gen it is fine. But seeing third gen civil servants taking its benefits is JUST NOT DONE. You are not half a lawyer if you support this. Only the poor and actual downtrodden should take benefit of reservation AND NO ONE ELSE. Only in India has this crime been allowed since independence. SCOTUS were it to have jurisdiction in India would have banned it long ago. (except for non-creamy). People being racist or casteist or body shamist will ALWAYS be there till posterity. Doesn't mean reservation will continue till posterity. If one commits a crime there is law to deal it. Giving free seats to creamy people is no solution.
Agree with you 100%. Punishing one's for the supposed sins of one's ancestors thousands of years ago is just ridiculous. Those downvoting your comment have no sense of logic.
This excellent quote epitomises the problem with race-based affirmative action in the US and caste-based reservation in India. Gen Z is graduating from college and soon Gen Alpha will take over. It's ridiculous that general category youths in these generations, born in the 2000s, are being penalised for misdeeds of their ancestors thousands of years ago! That goes against all principles of fairness!
If a person can't crack CLAT or the IAS in the merit list, that's because he/she isn't bright or hardworking enough, not because he/she is "oppressed". It's high time a challenge to the Indra Sawhney decision was mounted in the SC, citing the US Supreme Court decision.
Within the last couple of weeks, dalit people in MP have been forced to get peed on, eat human waste and face similar atrocities in the hands of upper caste men including BJP leaders. Thousands of years ago? It's still happening every day.
1984 riots, Kashmiri Pandits, Kamlesh Tiwary. Does that mean upper caste Hindus should get reservation in Jamia and AMU, or Sikhs in BHU?
No one deserves a reserved seat as a matter of right. We need to be a meritocracy. You canโt get 2/100 and get admission while someone who gets 60/100 is denied.
So let those people get benefit. Why should creamy people get benefit? Secondly a certain religion's conservative group have targeted upper caste Hindu's in myriad cases of violence. Doesn't mean everyone should get reservation. Only non-creamy and downtrodden should get reservation. What is the logic of giving reservation to the son of a second-gen powerful IAS's son?
