Sure, but it is the law of the land that changes to the basic structure require a popular referendum of some kind. Article 368 is impotent when it comes to changing the basic structure. Normal constitutional amendments passed by Parliament, whether ratified by the states or not, will not be enough.

The bigger tragedy is how readily people buy into the Opposition’s spiel without bothering to read the constitutional provision at the heart of the issue.

The 52nd Amendment, enacted by Congress itself, was specifically designed to address the “Aaya Ram, Gaya Ram” farce. In doing so, it expressly recognized that where two-thirds of a legislative party decide to move together, they are not liable to disqualification.

So what we’re witnessing is not some constitutional aberration. It is a scenario expressly contemplated by the Constitution.

Yet, if one spends enough time consuming the propaganda being rushed out by Newslaundry, The Wire, and the weekly sermon circuit of Kapil Sibal’s liberal baithaks, one could be forgiven for thinking that the Constitution says the exact opposite of what it actually does.

You may dislike the politics. That’s entirely fair. But presenting a constitutionally recognised mechanism as some great ethical outrage is not constitutional analysis. It’s partisan disappointment masquerading as principle.

The Constitution is not a physical law of nature like gravity or thermodynamics. It is a man made document reflecting the ideologies of the framers and their understanding of what the nation ought to be. Times have changed, and the present population through a popular mandate will amend the Constitution the way they deem fit. That is the very essence of democracy and why the Constitution is flexible.

6 months ago, or even 1 month ago, people would have laughed f you had told then that the BJP would get a 2/3 majority and push through delimitation, women’s reservation, one nation one poll, UCC etc. Yet, there were always signs that the liberal-conservative divide was just opportunistic political acting. Even as college students fought fanatically over their political loyalties, Mahua Moitra and Sushmita Dev were dancing at BJP MP Naveen Jindal’s wedding. Raghav Chaddha was enjoying a luxury London holiday with his glamorous Bollywood wife (the same guy who had declared just 2 lakhs a year annual income in his poll affidavit). The DMK was welcoming Adani in Tamil Nadu.

And now… AAP has defected en masse, the TMC is finished as a party, almost all the SS UBT MPs are looking to switch, and the DMK will probably have a back door understanding with the BJP.

Meanwhile, the CJP has proved to be a dud: mostly a bunch of jobless Insta boys with bot followers.

So basically our pluralist and socialist Constitution is all set to be amended wholesale and India will be turned into a Right Wing Rashtra.
