All he has done is retweet people like Prashant Bhushan, Indira Jaising, Ravish Kumar, Kunal Kamra, Mohammed Zubair of Alt News, Rajdeep Sardesai, the Wire, Al Jazeera etc etc. Just mere retweets and he got denied a visa!! If this is the standard, then 90% of Indian law students have left-liberal political views and will have retweeted or liked tweets by such people!! And perhaps criticised Israel too. So we all get denied visas now??? 😡😡😡
2. You seem to have thoroughly missed the point, as so many who are blinded by orthodoxies of any sort - be it ultra-liberal or ultra-conservative - usually do:
(a) It ain't so much the criticism of Modi as the criticism of Israel. They don't want that at all. Instead of reading clickbaity newspaper articles, you should read the actual "compact" between the Trump administration and the universities to keep their federal benefits that recently came into force. They do not want foreign students who express hostility to the U.S. or its allies. That obviously primarily includes Israel. Oh and I forgot, read the Volokh Conspiracy blog if you are serious about becoming literate in U.S. constitutional law and constitutional questions. (b) This would have to be a bit of a stretch, and they'd be really foolish if they tried to argue this. However, hostility to Modi (or at least, expressions of hostility to Modi) could be seen as a violation of the no foreign visitors who express hostility to us or our allies clause. They'd be foolish, as I said, to stretch the interpretation like that, considering Modi's pro-China tilt post the tariffs, but not impossible. And there is nothing preventing them from behaving foolishly if they want to - you, as a foreign citizen, have zero rights against them to hold them accountable.
(c) Are you guys that constitutionally illiterate? Do you not know that freedom of speech applies only to U.S. citizens, and not to you people? Do you guys not understand that literally nobody who matters or who is responsible for making decisions gives a shit about your outrage on Legally India (or anywhere else, for that matter)?! If you wanna be taken seriously, argue for how freedom of speech is being eroded for U.S. citizens. Or just sit this one out. We always tell Americans when they shove their ore into discussion of other countries' affairs, "Sit this one out". I think we may just need to follow the advice we give them. This is because this policy is neither as stupid or damaging (to the U.S. economy and U.S. interests) as H1B $100000 application fee (i.e., it doesn't have the typical hallmarks of being an administrative law red flags policy: they haven't failed to consider stuff they should have considered, nor have they taken into account stuff that they can't or shouldn't have taken into account), while also totally being within the U.S. executive's margin of appreciation.
(d) All of you guys are kicking up such a fuss about all this! Have you fools never learned to think about comparative practice? Do you not know that the British essentially have the same rules (even under the administration of Starmer)?! That celebrated points-based immigration system of theirs, created by Boris Johnson in 2021, blamed for the so-called post-2021 "Boriswave" of immigrants entering there, is basically a created-by-Oxford-gentlemen version of exactly this. Their questions on their student/work visa forms regarding "extremist content" are basically the same thing! Saw somewhere somebody creating about how the U.S. administration warning foreign students not to skip class! The fuck? The British have already got there!! So literally either concentrate on your studies, keep your heads down and actually do something to contribute to western societies, or stay in India and confine yourself to doing Palestinian protests there. You have no right to be admitted to any university or to be allowed into any state. Actually read up on the philosophy of immigration law. Maybe instead of screaming into the void on this far-left site, ask your jurisprudence teacher to recommend good texts on the philosophy of migration law. You know what? 1. For genuine left people: Listen to your conscience, avoid the US, do your postgrad at JNU, SOAS, EU, Australia etc.
2. For fakers cosplaying as left: Delete your pro-Palestine/anti-Trump posts, apply for an LLM in the US and confess that you want to work for a law firm (rather than misrepresenting your human rights credentials to get a scholarship, then eventually choosing corporate law electives).
