I am an academically diligent student. I never share notes, but a batchmate took out my copy and made photocopies for herself. Can I sue her for copyright infringement and IP theft? Serious question, I am very pissed at her.

Non Commercial Exploitation is bad defence here since the entire work was copied for the purpose for making the author's rights over the original work pointless. If they wanted to do this, they should have applied for a compulsory license.

And Copyright protects the expression and not the content. It's her notes and she has all the copyright over it thanks to the Act.

The case mentioned is not exactly applicable here as in that case revolved around question bank of maths problems. Notes are different and can be copyrightable. While obviously fair use is a defence it is for reproduction. An author always has a fundamental right that his worked is not published in the first place. If he had published the same and then it was copied section 51 would have been applicable
Yes you can. But why do all that? Go to the cops and file an FIR for offences against property. The taking of your notes without your consent is theft and you can add aggravated sections to it. Much easier if you ask me and will send the message you intend to send. (100% for it btw)

Go for it. People need to learn that this kind of harassment is not condoned. They are your notes. People need your consent before they can take them. (To the people who are making Marxist jokes, even Marx recognised personal property, these notes are personal property not capital). Please enforce your rights and send a message that theft will not be tolerated.

What I used to do to avoid this was I'd put easter eggs in my notes that only I knew were easter eggs. Always loved it when people who told me they didn't use my notes yet managed to list the same fake cases in their answers and lose marks for them. LOL.
I think well made notes require intellectual inputs and merit protection, so if you frame your case well you should be able to.
