Whats the process for getting a legal heir certificate in Mumbai for a person who has died intestate? And what are the usual timelines?
For a middle class person, the numbers, just as court fees being quoted is just exorbitant. My cousins were straight out told by a fellow lawyer, they hired that 75k is the court fees, without examination of documents, whereas the cap is 75k.
Please clarify if you are looking to obtain Legal Heir certificate or Succession certificate/ Letters of Administration issued by the High Court?
The court fees is 75k for SuccessionCertificate/ LoA. Needless to say your lawyer will charge you.Testamentary is the slowest department to exist. 8-10 months.
Please consider that the court fees is actually not exhorbitant as you can transfer assets worth crores.
