How fair are exam-based reservations in CLAT, probably the Supreme Court judgement clearly said that reservations should never negate merit, and reservations based on these does definitely benefit a class of group, but what about the consequences it has on other students without reservation. Where selection is a process of Rank + High Percentile Score in Boards + ECA + essays, scope of reservation makes sense.

Additionally a serious issue is that for whom reservations are made, they get bleak advantages of it. In the past years, the bunch of students I know from Bangalore, who happen to get in NLSIU, belonged to rich income family with as much as amenities as a burgeoning Middle class kid, but didn't grab the coveted seat with merit, but with reservation. This is absolutely insane. Just that years old caste certificate can't reciprocate with the position of individuals in the society now. As far as I know, our constitutional makers had reservations for the community economically (AND) socially backward, where do Pourarmikas/ Miners/ Janitors/ Barbers avail these reservations, probably they aren't even aware of CLAT or they lack money to even file the application for CLAT. Out of the 300 NLSIU seats, around 160 seats are for reserved category, and in this narrow number, majority studied from affluent schools like Kumarans, Christs, Joseph, etc have above median family income, where most of them find Symbiosis and even Jindal affordable, but they study cool in CLAT, because they know reservation has got their backs straight. The only point is "Reservation currently are failing to cater for those it was rightfully made, and should be made. It's allocated now to ones who are merely availing benefits of their ancestral category. The occupation of parents should be the prime criteria in allowing seat allocation, because right now the means are just literal and quantity oriented, they don't quantify and address whether just a seat with that pretty low rank of say 14000, 7000, 8000, did in any way give an opportunity to the slum dwellers, etc or the potentially backward people. Eliminating the economical tenet of the socially backward classes is a utter foolish step. Imagine I studied in a top-ranked school, my parents earn more than 10 lakh, I received quite commendable benefits of coaching, all things were ceteris paribus with my classmate. At the end, I end up getting in NLSIU not because of my strong rank but an outdated caste certificate which holds no value given the luxuries I was bestowed with throughout the tenure, but my friend scored more, perhaps better than my worse rank, still ends up wasting a whole year.

Re-assessment of caste validity should take place, the number of unfair or fair but elapsed benefits should be included in the General Category, if you don't want to redefine caste category how can discrimination terminate? In this 21st century, it's possible to recognize the suitability of an citizen to avail reservation, clauses perhaps more specific in this regard, where all reservation classes are said to produce certificates of economical backward which isn't a tiresome process and even a ITR/Pay slip can substantiate.

NLUs being the hub of law don't even realize that their approach to having reservation to safeguard the interests of backward communities is not yielding benefits for whom it was made, but to them who are just utilizing the different mechanisms to gain benefit from the system, who don't even care if their Tribal seat was to be deserved of their nearby Tribal relative who hardly earns an income in comparison of his bulky income. Wrong people take right benefits.

I absolutely understand the necessity of reservations, and value it myself. Also, the intention behind them is completely fair and equal representation. I feel horrific of thinking of 12th pass-outs, who aimed for CLAT, and must have to study in a quarter-like room with their parents involved in daily chores, and where even an application fee can send economic shockwaves to their families. I definitely and absolutely and unequivocally want these hardworking children to gain their righteous seat in NLUs. They deserve it by no further clarification, and the all reservations of OBC, ST, SC, belongs to them to belong to different corners of a city, state, nation. They do require upliftment and a quality education and reservation can equally place them with other students and not at disadvantage. BUT, unfortunately, not more than 100 are able to get a seat in the entire 3000 seats of National Law Universities. So, where do the rest of the majority reservation go to, to those kids with wealthy families in their bracket who happily and perhaps cunningly are capitalizing on the benefits of a caste certificates, where they not even a bit deserve that seat. These caste capitalizers should have competed in the General Category and spared the reserved seats for students battling through the process. Providing caste category benefits to "all" in that category is foremost a rubbish policy specially in education system. Whichever NLU you are, just ask to the management in the RTI about the number of reserved students in your class belong to the abject picture described? The managements don't have answer because changing these rules and making it individualized is a tedious and self interrogating process.

I dont oppose reservation at all, i am in favour of it. As long as it doesnt breach 50 percent ceiling, i am not in favour of EWS though. But any attempt to criticise its implementation can never be shut down. Reservation is representation and it is duty of the state of ensure a wide spectrum of castes and sub castes find their representation in govt colleges and jobs.

Very good solution is sub classification and horizontal EWS reservation in SC/ST/OBC, so economically weaker among can take benefit. And Abolishment of UC EWS reservation. Then you would see truly diverse crowd in jobs and institution.

And declare 50 percent ceiling as inviolable thereby balancing right of opportunity and representation.
