A few weeks back, the Batch representatives (across the various programmes) reached out to us to seek clarification regarding the Moot Court and Trial Advocacy Course.
This is to inform you that as per the BCI and OCS policy, each student has to undergo a trial internship, and
has to prepare an internship diary as envisaged under Rule 24 of BCI policy (based on the interviewing, pre-trial and trial proceedings). While there is no fixed format stipulated by BCI for the trial diary, I have prepared a document for your reference.
The batch representative came with various concerns (as per your inputs), I have made an attempt to cater to the same:
Re: Concern Regarding the Trial Diary
We understand the foundational time of your law school was online due to the COVID-19 pandemic. However, students from five-year integrated programme are required to attend a trial internship, preferably from the third/fourth year onwards (Refer to Rule 24: Moot court exercise and Internship, the BCI policy of Legal Education).
The reason behind this requirement is that the students learn about core civil and criminal procedures starting from the third year onwards. So, the time that has been spent during the online semester is insignificant to your trial internships.
Alternatively, the three-year programme students had all their semester physical (except first, wherein it was hybrid). So, the online period does not concern them.
PLEASE NOTE, there would absolutely be NO RELAXATION pertaining to the Trial Internship. The absence of a trial internship enables BCI to reject your degree.
This is the year when as per the BCI policy and JGU policy (based on BCI policy), you should do the trial internship. I suggest all of you shall utilize the period of December 2023- January 2024 in fulfiling your trial internship requirements (If not done already). Each one of you have the luxury of 6 weeks of internship time before the commencement of the new session (Spring 2024).
Kindly understand that it is a mandatory provision, the absence of a trial diary will bar your degree, needless, to say the pre-placement offers would hold no basis in the absence of a degree.
Re: No conflict between OCS and BCI policy
There is absolutely no conflict between the OCS and the BCI policy, both the policies (Clause 1.3 of OCS policy and Rule 25, Schedule III of BCI policy) mandate the student to take a trial internship. While doing the internship is mandatory, the timeline of doing such an internship is flexible. Please see Clause 1.3 of the OCS policy (the word 'preferably') and Rule 24 of the BCI policy (the word 'may') only make a suggestion regarding the timeline and does not impose a strict timeline. This means that the students may take the trial internship at any given time during their degree.
In case you have already satisfied the condition of the trial internship (Rule 25, Schedule III of the BCI), feel free to make a trial diary from the previously attended hearings.
Re: Nomenclature of a Trial Diary
As per the BCI mandate, each trial diary shall have the following ingredients:
1. Observance of Trial in two cases: one Civil and one Criminal (15 marks each; Total- 30 marks) 2. Interviewing techniques: Observation two interviewing sessions of clients at the Lawyer’s Office/Legal Aid Office and record the proceedings in a diary. (15 marks) 3. Pre-trial preparations and Internship diary: Observation of the preparation of documents and court papers' by the Advocate and the procedure for the filing of the suit/petition. (15 marks)
Each student shall submit the diary to their respective course instructor at the beginning of the semester and the diary will remain with JGU (JGLS) as a part of their record. Please note that the trial diary shall be in a digital format (i.e. typed on word document). No hard copy or scanned diary would be accepted/allowed.
Re: Delayed Information regarding MCTA policy
Being a law student BCI policy should be a part of your common knowledge (it's open in the public domain).
Notwithstanding, as per your course curriculum and BCI mandate, the MCTA policy becomes relevant in the 'last two or three years of law programme'. Since it is an 'or' provision (Refer to Rule 24, BCI legal Education policy) and the same has been communicated to you in 2022, there is absolutely no delay in the communication.
Re: Taught Course
As per BCI policy, all the mandatory courses have to be the taught course. Since MCTA is part of the compulsory course structure ( under both JGU and BCI policy), it will be a taught course.
She promised somethings in the meeting and didn’t abide by them in the email (which was sent BEFORE the scheduled consultation- which was also unilaterally cancelled by her)
Jindal recently introduced an MCTA policy and the new programme head is asking kids now to get internships for Dec-Jan and intern under a trial attorney to complete the BCI mandated trial internship. I mean who gets internships at such short notice (not to forget people must have prior commitments/internships or are trying for jobs- being from GB) and why are you informing us now about this requirement?
She further threatened to withhold degrees and job offers of kids who already got jobs.
