P. S - When we call the judicial service a govt service, I feel we're not acknowledging the basic structure of our constitution that the judiciary is an independent pillar of our democracy. So, from now on please call it public service or simply, judicial service.
The govt. has 3 organs: legislature , executive , and judiciary.
You want Judiciary to be called public service but in the same sense, government service is public service, government employees are called public servant not Govt servant, Govt companies are called Public sector Undertaking not Govt. sector Undertaking.
Also it is not distinct from our constitution that judicial pillar and executive pillar are very distinct, as per constitution higher judiciary is to be appointed by head of executive which in turn appoints Lower judiciary.
Government has 3 parts Legislative, executive and Judiciary.
Do you also want those working in Assemblies and Parliament to be referred as legislative service?
I hope you understood my point, if not, all I have to say is, you look like some who is looking for a reason to outrage.
Talking about the public service thing, I just want people to not call it government service at all and call it anything else.
The Supreme Court, in the Review Petition All India Judgesβ Association v. Union of India , AIR 1993 SC 2493, in its judgment delivered on 24 August 1993 had held that, "The Judicial Service is not service in the sense of βemploymentβ. The judges are not employees. As members of the judiciary they exercise the sovereign judicial power of the State. They are holders of the public offices in the same way as the members of the council of ministers and the members of the legislature."
The above observation has consistently been followed in subsequent judgements including the ones delivered by SC in 2023!
