Which are the practice areas that are more fact Intensive and involve less black letter law?
Criminal litigation involves heavy knowledge of both legal provisions and case law. Civil on the other hand (especially property, family, MV, consumer etc) is mostly fact based.
I would strongly disagree - criminal law is far more fact dependent than civil law. Caselaw plays a much lesser role as well
Only in bail petitions. Trials and appeals are quite heavy on precedents.
