The national media is silent about this case and is only now taking notice because of the clash with the SC, but it has been on the Bengali news for the past six months non-stop. Here's the ground report from Bengal:

- The victims of the scam are going on a dharna for the past several months and approaching the Cal HC. But the Cal HC is perceived as too afraid to take the Bengal education scam forward, because they know where the trail will lead.

- Meanwhile, The ED and CBI are going veeerrrry slow on the case.

- Thus, all over Bengal, there is talk of a "Didi-Modi setting". This means that the Modi govt (through the ED and CBI) us deliberately going slow because Modi needs Mamata to split the opposition. More seats for Mamata means fewer seats for the Congress-Left coalition, who are the BJP's deep-rooted ideological enemies nationally. The Cong-Left are gaining ground in Bengal and the TMC recently lost a crucial by poll to them in Sagardighi, a Muslim-majoirty seat.

- Along comes Justice Gangopadhyay, who behaves like Salman Khan in Dabang. Not only does he blast the TMC govt but also the CBI and Modi govt. He makes many political enemies, but is hailed as a god in Bengal.

- Unfortunately, he takes the tough guy act too far and starts speaking to the media.

- Pouncing upon this, AM Singhvi goes to the SC and throws a fit.

- SC agrees with AMS and then the drama happens.

- Meanwhile, the SC order has reignited the "Didi-Modi setting" talk.

What the SC and national media have no clue of is that Justice Gangopadhyay is seen as the only honest, strong-willed crusader against corruption in Bengal.

That's the background.
Do not agree with the last part. Many people in Bengal could see how transparently that judge had been trying to score political points without really trying to achieve justice. He focused on making headlines instead of giving the right set of orders. The ones that he gave were full of legal loopholes, which got stayed by the division bench or the SC. โ–ฎโ–ฎโ–ฎ
Because it was needed. The investigations gained momentum because of that. Many new evidences were produced and many people got arrested because of the same.

Talking about headlines, I don't think there is anyone better than the current CJI in that regard๐Ÿ˜‚
No judge will ever be able to replicate what Justice Gangopadhyay has done. He was the one who used to put deadlines and ask for updates from CBI/ED to investigate. Most important, no lawyer was able to force adjournment on him. If we had judges like him, pilling up of cases or adjournments would not have been such a problem. The amount of corruption that he has unearthed in the last 2 years is just incredible.
We do not need any more judges like him - please! If you are going to be so open with your biases that you're even going to give news interviews, please join some other profession! One can be tough without being an idiot
Err...he did not manage to get the CBI or the ED to file a single chargesheet in all this time, and most of his orders got stayed by the higher benches or courts on account of legal infirmities. Not a very good judicial performance overall.
The people on dharna are not victims of the scam. They are the beneficiaries whose appointment has been stayed/cancelled by the same HC whose praises you sing off. As for Justice Gangopadhyay, he is a transparent political โ–ฎโ–ฎโ–ฎ who rightfully got a beating before the SC. I sometimes marvel at the amount of nonsense people post on this site about affairs on Bengal.

Do you even know what had happened?

The results were manipulated, people who had submitted blank sheets were marked the highest in the exam and given jobs and the people who had actually scored high and deserved it (so called, beneficiaries) were denied.

After the investigations, do you know which orders got stayed? Orders where Justice Gangopadhyay had ordered SSC to submit the OMR sheets. Eventually, CBI/ED had got to the OMR sheets and the jobs of all these people had been canceled and Justice Gangopadhyay had ordered the govt to provide jobs to the so called beneficiaries in place of the people who had gotten jobs by paying bribes.

There are audio clips and other evidences to show that bribes were paid.

This whole thread proves that the people from other states have no clue of what's going on in Bengal !
You have it backwards. Due to scam (alleged) all appointments (allegedly fraudulent) were cancelled. No determination has been made yet about who is (and is not) entitled to appointment. The people protesting are largely those whose appointment was cancelled (a small number are those who claim they were wrongly not appointed). Thus, if you accept there was indeed a scam, most of the protesters are beneficiaries of the scam (as they were wrongfully appointed). Now, one possibility is that only some of the people initially appointed were wrongfully appointed and cancelling all appointments was disproportionate. Regardless, nobody is protesting in favour of Justice Gangopadhyay.

Quite apart from that, any judge who can give such a brazen public interview on a sub-judice matter should not be anywhere near that matter. As an aside, I don't know what it is about the Cal HC but we've now had two judges who've asserted that they are higher than the SC (Justice Karnan ordering WB police to arrest SC judges and now Justice Gangopadhyay passing orders against SC Registry)

The article quotes him as a "people's judge". Any judge who is a "people's judge" will necessarily be a bad judge. A judge isn't supposed to be the people's, but the law's. Government is supposed to be people's. I would call this first-year law school knowledge, but it's not even that - it's Class X Civics. Unfortunate that his lordship himself seems unaware of this.
I would like to report this comment as trollish to the extreme. Young graduates who are victims of corruption are on dharna and hunger strike, some have committed suicide. Yet this pro-TMC troll has the audacity and insensitivity to call them "beneficiaries". On the contrary, they are protesting against the unfair and illegal beneficiaries. Even โ–ฎโ–ฎโ–ฎ would be embarrassed at such disinformation.

Some people are used to receiving alms from the government in the form of Rs500/month etc and so the only thing they understand is beneficiary!

After the decision of the SC, the case was moved from the bench of Abhijit Gangopadhyay to Justice Amrita Sinha. Today, not only has the decision of Abhijit Gangopadhyay been upheld but a fine of Rs25Lakh was imposed on Abhisekh Bannerjee.

The number of cases that this party or the govt has lost and the amount of money they are spending on litigation is astounding!
Yes, every judge of Calcutta HC is biased against TMC cuz they know the ground reality. The decision may seem a bit absurd for people with little knowledge about the on ground situation.
When blank OMR sheets of candidates who have qualified the exam are produced in the court, I don't know why a judge should delay the cancellation of their job. SSC has submitted OMR sheets of candidates who have qualified the exam and not a single option has been encircled in those OMR sheets but they have got almost full marks. The Cal HC ordered the cancellation of their jobs but it got stayed by the SC. Sorry, but I don't believe in this rule of law
As predicted earlier, the order dismissing the 32000 people from the jobs has been stayed. For all those trolls here who believe criticizing the legality of a judgment is equivalent to supporting the political party who got berated because of the judgment, this should act as an eye opener. Unless you're claiming that other than that one judge, all other judges are party stooges.
Have you read that judgment? Please do not go for random live law click baits. At least read the last two paragraphs of the order of the division bench where they mentioned that jobs cannot be taken away till September. However, recruitment exams will have to be conducted for those 32k posts by August and if these 32k candidates qualifies for the post then they can retain their job else, they would be dismissed.

In effect, the dismissal has been delayed until fresh recruitments are done.
All of the genuine people will qualify. If you were aware of the law, then you would have known that the issue was in Bengal, the teachers were allowed to get recruited and then get an additional training done within 2 years. Most of these 32000 did get so trained, which is why it was stupid of the earlier judge to have dismissed all the jobs. All those people will not only get points for extra training in this new recruitment but also points for the work experience, so they are a certainty. All that this faulty dismissal judgement did was to cause them harm in terms of mental anguish and reputational loss, for which that judge playing to the gallery was entirely responsible. If he or the investigating agencies could not identify the actual culprits, that's their fault and not of these people who got the jobs fair and square.
