i think OP is specifically talking about domicile- this is not even constitutional. for example- mnlu mumbai has around 60-70% reservation for students from maharashtra, nls, nalsar and nlud have reservations specific to their states, and all these states have some of the highest per capita income in the country. meanwhile people from states who are actually less privileged than people from metro cities etc. have no domicile reservations or only domicile reservations in T3 NLUs

I've always found this argument stupid. Existence of one flawed system does not justify the existence of another. We all know that the NRI Sponsored quota is a glorified management quota (none of them are actual NRIs).

In STs, mostly Meenas take all the seats while in SC, it’s Jatavs. Other sub castes almost never get a chance. It’s high time we introduced creamy layer in SC ST reservations. nalsar first needs to get rid of the foreign category quota, or at least introduce guardrails (such as needing to study in the foreign country for x years). Calling yourself a "top 2 nlu" while allowing candidates with ranks in the 5000s and class 12 scores of 75%, who have spent their entire school life in india, to secure admission, solely on the basis of citizenship status is absolutely preposterous.

Completely agree. Reservations should never be permanent. We need to get over things like caste, religion, region etc and think more as a Nation. You can get the problems when politicians praise and reward the Olympic medalist only from their state and not call them proud Indian or Vandana Kataria's (women's hockey player) caste comes into picture while discuss about India's defeat. Only identity should be Indian and only ideology should be humanity. Politics needs to focus on capability and merit rather than caste.

I strongly oppose reservation of any kind. It represents the death of merit and gives a message to certain communities that they are "backward" and not good enough. It also hurts India's economic and scientific prowess and leads to brain drain. To those who disagree let me just reproduce what Nehru said:

Regarding your comparison with NLSIU, it again reveals your ignorance. NLSIU has received a lot of state funding during its initial years, and have been allowed to continue distance programmes without regulatory approval for long. And no, providing NRI reservation for funding does not 'defeat the purpose of' SC/ST reservations. The objectives are completely different, and the former isn't being done at the cost of the latter. As for that tier one NLU, they actually implement all the reservations that they are required to under law, unlike NLSIU that has been hauled up by authorities several times for not having done that.
Your agendas are actually quite transparent and trying to hide those by psedu-advocacy of meritocracy isn't fooling anyone.

Wait this is the author of the discussion, why are the commentators deforming my comments? Never did I say that reservations are not necessary as insinuated in comment 2 nor did I rant against SC/ST reservation as insinuate in comment 3.

Infact, what I asked for, was a better implementation of the reservation for SC/ST so that more people from the community get to benefit from the same. What I am saying has been researched by multiple scholars, that a small population within the dalit community has been repeatedly using reservation and that is one of the major reason that even today major chunk of the community has not attained social and financial mobility. (There are other reasons like illiteracy etc but this is a major reason too). All I am asking for is a better implementation of reservation policy for the oppressed communities so that more people can benefit from the same and enter the system. I don’t think this should hurt anyone, except if you’re from that small chunk of people who’ve have been repeatedly taking up the reserved seats denying others from your same community a level playing field.

Regarding NRI quota and lack of funding pointed out in #2, there could be a million ways to make money like the online courses launched by NLS. NLS does not have an NRI quota and I am pretty sure they are doing good. All they have to use are some braincells rather than letting students with no merit or reason to be deserving those seats enter. For a fact, there is this “tier-1” university in India where the number of seats reserved for SC candidates is equal to those reserved for NRI sponsored candidates. So basically hundreds of years of struggle and oppression is equated to upper caste capitalism? Doesn’t it defeat the very purpose of providing reservation to oppressed communities when on the other hand you are reserving the same number of seats for the very people that oppressed them for years? This is what their struggle and oppression is equated to?

NRI quota helps us folks who can't afford NLU fees let alone Jindal fees have slightly reduced fees so some rich brats can pay to be there and subsidize it a little for the rest of us.
Domicile reservations- worth talking about, but I think you'll find your opinion is not very unpopular in this respect.

Study law properly and you will realise why the reservation is necessary. That topic does not merit any further discussion here. Plenty of literature is available for you to study from.
As for the NRI quota, if the government provides enough funding to the NLUs and nationalises those, then it will no longer be needed. It is there currently only for extra funding. Better than having management quota seats with opaque admission policies.

Before I go ahead with this, I want to clarify that I have no issue with reservation as a policy but only with it’s current implementation and usage for divisive political motives.

I gave CLAT this year and secured a decent rank. I got into a top 5 NLU but decided to go with JGLS because finances were never an issue for me and I wanted someone who actually needed a seat to have it. It was anyways either NLS or NALSAR else JGLS for me from the start. I don’t feel pity for myself on losing out on my top 2 preferences. But I do feel bad about my friends from coaching institutions who were extremely deserving but couldn’t get in due to the increasing reservations (mostly domicile) but the seats for general candidates in universities like GNLU are extremely less. With a score that would have got me into the top 2, a couple of years ago, I couldn’t even land a spot in the top 3 NLUs. My friends who gave CLAT last year too, realised that it is becoming tougher each year to get into the premiere institution. There is no basis for domicile reservations except for political reasons. If all NLUs shall have domicile reservation at some point, it will be extremely anti-underprivileged because Karnataka, Telangana and New Delhi are all states/UTs with high per capita income and most underprivileged people come from UP, Bihar, North east etc. Even after breaking all societal and financial barriers, a student secures a decent rank only to be held back by divisive politics. Not just domicile but reservations have been constantly increasing. Graduates from top NLUs have had so many landmark judgments to their name but not for once did anyone challenged the irrational NRI quota. Nobody discusses it or considers it as a problem, let alone challenge it. Reservations are needed but even in the scheduled caste and scheduled tribe communities, most people can not avail it till date. This because of the poor implementation of the policy. People who perused reservation once and get a social/financial status gain an advantage over people who haven’t used reservation for once. This small community of educated SC and ST within the larger oppressed community has been taking over all reserved seats again and again depriving others within the larger community of the same. But instead of addressing and improving on the policy of reservations to make them more inclusive and beneficial for the people that it was introduced for, the divisive politicians have casually been increasing reservations to garner more votes and incite communal differences. There has to be a stop to increasing reservation at some point and domicile, NRI, foreign national quotas have to end.

I went to JGLS because I had an option and enough capital but my friends, they belong to nowhere. I can’t ask a friend to get into CNLU when he deserves much more. This needs to be discussed. Please.
