No, it wasn't. I gave the very first bar exam myself. It used to be open book from its inception. In fact, we had been told that the Rainmaker modules would be where all the questions would come from. And they did.
Make the exam tougher as well. The pass rates in foreign bar exams is between 10 to 40 %. It should be like that here as well. Those who fail can do other jobs.
A lot of lawyers who will never see the inside of a court also have to pass the bar exam. Having an arbitrary standard like that doesn't help, especially when the legal education system in the country is a joke
Great news! Another change should be that the syllabus should be modelled on NLU syllabus, i.e. a greater stress on comparative law, private and commercial law. We need a situation where 100% of NLU grads clear the exam, while it is 10 to 20% for others. This will ensure quality in the Indian legal profession.
As far as we understand, the bar exam had always previously been an open-book exam.
