All of that is good, but considering the fact that the genesis of environmental law in India is literally through cases (mostly filed by M. C. Mehta), taking your argument on face value would mean India would perhaps be uninhabitable at this point with water and air pollution if the courts had never stepped in.

The courts have an incredibly important role to play when the danger is immediate, and things are politically sensitive. Air pollution means that a lot is at stake: I lost my grandfather because of an air pollution related complexity. He should never have had to go so early. I am sure there are thousands, if not millions of people like me; we should all do our little part: the people, the courts, the legislature etc. When one does not, someone has to step in to do the job; the job cannot be left undone.

All those marked trollish, have no relevance to the thread. There are other platforms available for what about questions or philosophical pondering (whatever you call it). The thread is about fircracker ban, PIL, and trolling of the said person. I have moderated similar comments on other more "political" threads, which from what I understand have been made by "LW". This same old argument of people's livelihood depending on making and selling crackers got to stop at some point of time. Governments won't do anything about it ever if it's left to them, because environment and pollution have never been a point of concern to risk losing a vote bank. So long as crackers aren't banned, people will keep seeking employment in that industry and the vicious cycle will continue. These things are slowly killing all of us and they serve no essential purpose unlike automobiles either. I am not even going into a religion related debate because crackers aren't part of any religion. Jurisdiction debates won't save us when we are choking to death or from lung diseases. It's literally a life or death situation, and I fail to understand how educated people can pretend otherwise. It is true that cars cause more pollution, but there is no viable alternative for those yet and as I said, they still serve a useful purpose. Crackers do not. Never did, never will. The SC has shirked its responsibility in this case. Making woke headlines comes to those judges easily these days, but passing actual orders that will make a difference doesn't.

First of all, it isnt the judiciary to run into the realm of the executive and make very significant policy decisions like these. These are decisions concerning the people at large, and would be illogical to assume that it could be enforced in one day. Such stuff is better left with the peoples elected state/ union legislature to decide, people who actually (at least to an extent comparatively) know the ground reality, the Supreme court has done exactly what a court is mostly supposed to do, cooperate to maintain a legal status quo.

But this does not mean that the person raising the issue, should be threatened and abused in such a manner, and this is highly condemnable, but this actually shows that the public morality and needs have to considered and deliberated, with negotiations for months, to completely ban a product used for decades, and make alternatives for the millions and millions of workers who would be thrown out of the market as a result.
