I am currently going through a tricky situation. It will be really great if one of you could help me with this issue.
I bought a house in salem, tamilnadu in 2009 for 18.25 lakhs, of which 14 lakhs was taken as home loan from SBI, Salem. My Power agent had bought this on my words, as i was in US for my work.
After an year of purchase, I rented out the house to my paternal uncle in Feb 2010 and went to US - No lease agreement was made and no advance was collected. Unfortunately my paternal uncle died the same month and my uncle's family was staying over there without paying any rent. Even I didn't mind that as they were going through tough times.
After 6 months I started getting a rent of Rs 2500/month in my ICICI bank account. This continued for 10 months. Later my uncle's family stopped paying rent and didn't care about the phone calls that I used to make for the same.
In March 2011 I returned to India for good, and my finance status started weakening as I had to pay for SBI loan (12000/month), rent for house in chennai (10000/month) and EMI for a new house in chennai which is under construction (19000/month). At this stage (Nov 2011), I felt the need for money, that I can get by selling my house in salem (so that my home loan at native will go away and my loan burden in chennai will come down)
I informed my tenants immediately, they too agreed. In March 2012, I found a buyer for the house and after signing an agreement with him, my tenants asked for a month time. I gave them the same, but they didn't keep their words. Instead they went to court asking for injunction from them being vacated from the house.
Since April 26, 2012, I have been fighting this case with no progress.
I am thinking of filing an eviction suit in the local court (rent controller).
Is it the only option with which I will be able to save myself from this issue?
If so, Is there a duration by when eviction procedure will complete?
