Infamously, property disputes in India can be long-winded, sometimes lasting decades, and messy. However, forewarned is forearmed, particularly in case of property ownership. Your right to own or live in a property, or the monetary value of a property, can turn into an inter-generational dispute when contested in courts. Often such disputes can involve legal and other costs greater than the actual value of the property, and even threats of physical violence over disputed property are not unheard of.

Therefore the best way to stay out of the mess is prevention and due diligence.

The foundation of avoiding property disputes is to be in possession of all the documents proving your right to your property.

Take an active interest in the process of buying and selling your property from the start, conduct background checks for proper title, get the "title search report" and clearance and approval reports from a lawyer, understandyour loan terms fully, and make sure you sign balanced lease and other agreements to begin with.

An example of the utility of background checks: A builder may acquire agricultural or forest land and change its use to residential mid-way. If before buying your apartment in such a builder's township you come to know of this, you can escape the situation where work on the construction of your residence goes into limbo due to a lack of clearances that should have been obtained by the builder.
