SC bench hearing Hardik Patel’s appeal against sedition charge sends case to a different bench

download-orderAfter hearing the matter for 45 minutes, the Supreme Court bench consisting of V Gopala Gowda and Amitava Roy ordered the registry to list the matter before a different bench.

Hardik Patel has filed the special leave petition to appeal against Gujarat High Court’s order of October 27. By this order, High Court had quashed the FIR against him for offences punishable under Sections 153A, 505(2) and 506 of the Indian Penal Code (IPC) but had allowed the investigation to proceed under Sections 124A (Sedition) and 115 of IPC. The FIR has been filed against him in relation to the Gujarat Patidar agitation led by him which caused riots and extensive loss of property in several areas of Gujarat.

The sedition charge has been filed for his statement to one Vipul Desai, which was video-graphed and also telecasted on the local TV channels, wherein he allegedly said:

Kill two to five police officers, otherwise, son of a Patel would not die.

Before the Supreme Court, Patel was represented by senior counsel Kapil Sibal. After hearing the matter for around 45 minutes, bench ordered:

List the matter before another Bench after obtaining necessary instructions from Hon’ble the Chief Justice of India.
