The Delhi high court has agreed to hear advocate _Deepak Khosla_’s appeal for video recording of all court proceedings in the high court, after it had initially dismissed the plea in August 2011 and again in July 2017 with Rs 20,000 costs that Khosla said he would not be paying.

Khaitan & Co’s Calcutta partners and some of the firm’s current and one former associate have been summoned by the Calcutta high court to respond to perjury and criminal contempt allegations made against them by advocate Deepak Khosla on behalf of his client.

The Delhi high court took serious exception to its two-judge bench being called a “Dedh Bench (one-and-a-half bench) by advocate Deepak Khosla and ruled, last week, that he was in criminal contempt of the court.

Advocate Deepak Khosla is appearing for Bharti and told Legally India that he would appeal before the high court today and prove that the case was an abuse of the criminal justice system.

Bharti was last week named in a first information report (FIR) filed under many sections of the Indian Penal Code, including domestic violence and attempt to murder, at Dwarka North police station in west Delhi.

Police said they filed the FIR following the June 10 complaint by Bharti’s wife Lipika Mitra, who said the AAP leader has been abusing her ever since their marriage in 2010. She also claimed that Bharti beat and tortured her and once even tried to kill her.

The union government will urge the Supreme Court’s e-committee to allow audio-visual (AV) recording of Supreme Court proceedings to “usher transparency as it would discourage witnesses from retracting their statements” and to prevent “unwarranted delay in trials (through re-recording of witness testimony)”, reported the PTI.

The law ministry cited law commission chairman justice AP Shah’s pilot project of recording court proceedings in district courts, to request the e-committee to reconsider the AV recording proposal it had rejected last year.

AV recording of court proceedings was in the agenda of the Aam Aadmi Party during its short-lived tenure forming the Delhi government in February 2014, but does not find a place in the agenda of the party currently as it forms the Delhi government for the second-time.

The hearing between advocate Deepak Khosla and Khaitan & Co in Kolkata on Thursday (18 June) will be video recorded, in what may be a first in any of the country’s high courts.

On 13 February 2014, towards the tail-end of the Aam Aadmi Party’s (AAP) short-lived first tenure in charge of Delhi, then-Delhi law minister Somnath Bharti wrote a 15-page letter to his party colleagues.

The Supreme Court’s e-committee has rejected the government’s proposal to start recording court proceedings stating that it was not acceptable at present, reported the Times of India, quoting sources, though it did not report further details on the reason.

The government had mooted the proposal in August in an advisory council meeting of the law ministry, held in Delhi. Starting with all 15,000 subordinate courts as a pilot project, it was proposed to move it up to all levels, to increase transparency.

The Delhi High Court Bar Association had also vowed to meet the law ministry at the end of the court’s summer vacations, with the proposal to initiate audio video recording of court proceedings.

Allowing litigants and lawyers to independently record court proceedings has also been a long-running cause pushed by Delhi advocate Deepak Khosla.
