Amarchand takes Nokia Siemens v BSNL fight to Punjab

Amarchand is battling on in Punjab & Haryana for telecommunications company Nokia Siemens Networks (NSN) in its attempts to sue state-owned telecoms operator Bharat Sanchar Nigam Ltd (BSNL) over a Rs 30,000 crore ($6bn) contract.

Amarchand & Mangaldas & Suresh A Shroff & Co litigation partner Ritu Bhalla is leading the NSN team, which has today filed another petition against BSNL with the Chandigarh High Court in Punjab & Haryana.

NSN may also take the case forward in Mumbai and Hyderabad after the Delhi High Court last week dismissed NSN's petition. BSNL argued that the disputed tenders took place in Chandigarh, Mumbai, Hyderabad and Kolkata and that the Delhi Court lacked jurisdiction to hear the matter.

Rohit Khanna and D.R. Sharma are acting as the respective advocates for NSN and BSNL in the present Chandigarh petition.

Senior advocate Abhishek Manu Singhvi and senior counsel Vikas Singh represented NSN and BSNL respectively in Delhi.

NSN hopes to challenge BSNL's decision to disqualify its bid for the network contracts, alleging a lack of transparency in the tendering process.

Amarchand declined to comment on the case.

Motorala filed a petition against BSNL in the Delhi High Court in October 2006 over a $5bn bid, in which it also alleged a lack of transparency. It is understood that the case was settled and that Motorola withdrew its claim to enable BSNL to continue with the process of its network expansion.
