The First Edition of GNLU Military Law and Justice Program was organised from 26th July- 1st August, 2015 which included the themes mainly based on the concepts of justice and the changes brought-in under the Indian Military Justice system. Participants for the program included officers from the Navy, Army, Air force, ITBP and BSF.
2017 Academy will mainly focus on the concept of Militarism, Martial Law, Human Rights of the Forces and Global Perspective of Military Laws. Participants for the program will include officers from the Navy, Air Force, Army and Para-Military Forces. 2017 Edition will take a step further towards global perspective of the military law, focussing on the English Articles of War on which the Indian and US military laws are primarily based. With the winds of necessity, the laws have evolved and the practices have changed.
The era of globalization has brought the people of the world closer to each other than ever before. But with that it has brought its own baggage of problems - terrorism being most dangerous one, increasing one’s tendency to want more safety. This calls for newer and better structures to fight with these unconventional problems. Taking a glance at the USA one can find a well designed and operating system of DEFCON, Homeland Security System, National Terrorism Advisory System, MARSEC and other structures for defense. In India we have the infrastructure and man power but there is need to develop the super structured system.
Many major countries have been through a phase of martial law. The martial law practice has made us understand the values of human rights. Frequently we forget that on deployment the troops are the first one to lose their human rights. In the inhumane conditions of war, as a prisoner of war, etc. Geneva Conventions and other conventions provide for the rules to maintain troop’s dignity and human rights.
In the present era of welfare state, the concepts of Human Rights, Fundamental Rights of the Armed forces personnel vis-à-vis the civilian population suffering during war cannot be neglected. In the present times, there is a need to value Rules of Natural Justice, Human Rights, International developments in Military Laws, humanitarian laws and defence system prevailing in other countries of the world. The Academy will focus on analyzing the current status of these laws and how different they are in practice. It aims to come out with suggestions to establish similar and better institutions in India. The present Edition contains the various facets of laws governing the armed forces, international humanitarian laws, law of war and military justice system in India with comparative study of military justice systems in USA and UK.
