Naik Naik & Company managing partner Ameet Naik with senior advocate Ravi Kadam acted for Phantom Films in their Bombay high court appeal against the Central Board of Film Certification’s decision to ban the film Udta Punjab by not issuing it with a certificate.
Other lawyers acting for the movie studio include Ashish Kamath, Madhu Gadodia, Ravi Suryawanshi and Vaibhav Bhure.
The petition seeks the Bombay high court to direct the chairman to issue an A certificate for the film, or to issue a “reasoned decision” on the film maker’s application, before the film’s scheduled 17 June 2016 release.
It challenges the failure to provide a certificate in a timely manner to be wrongful, arbitrary and unreasonable, that the CBFC’s failure to issue a certificate was violating Article 14 of the Constitution and:
not only illegal and unconstiutional, but the same is also afflicted by the vices of legal malice, colourable exercise of powers and manifest arbitrariness
The petition also alleges violation of fundamental rights under Articles 19(1)(a) and 19(1)(g) of the Constitution, as well as several other grounds.
