Exclusive: Bar Council of India (BCI) members passed a resolution in the absence of chairman Gopal Subramanium today to postpone the bar exam by three months until 6th March 2011, as the BCI is also understood to have discussed future involvement by Rainmaker.
Three independent but authoritative sources close to the BCI told Legally India on condition of anonymity that a quorum of BCI members convened today (Sunday, 14 November) for a meeting and passed a resolution that the proposed All India Bar Exam would not take place on 5 December 2010 but would be postponed to next year.
BCI chairman Subramanium, who is also solicitor general, was not present at the meeting. Legally India was unable to authoritatively confirm the reason for his absence at the time of going to press and Subramanium did not return Legally India's requests for comment by phone and email.
At 8pm today BCI spokesperson Gopal Sankaranarayanan could not confirm that the BCI members had passed a resolution postponing the bar exam, but said that before the decision could be final from an "administrative point of view" Subramanium would have to sign it.
It is understood that the BCI members' main reason for postponing the exam was because a large number of students had not yet received written bar exam materials and because members proposed greater involvement of state bar councils.
It was proposed that from next year the BCI would select up to six state bar councils, whose chairmen would then jointly set the paper.
It is understood that BCI members also decided that legal industry services provider Rainmaker would continue running this first exam but the company would not be selected to run the second exam. Rainmaker was unavailable for comment at the time of going to press.
Legally India could not confirm whether any special allowances were considered be made for 2010 graduates who may be unable to practice until the exam now takes place in 2011.
A number of other issues, such as closures of law schools were also discussed by the BCI members at the meeting.
The deadline to apply to the bar exam is tomorrow (Monday, 15 November). Last week Legally India reported that the legal avenues in the Supreme Court transfer petition of bar exam challenge cases were almost exhausted, as a number of petitioners were inactive.
UPDATE 15 November 2010, 11:10am: BCI member and Delhi Bar Council member Rajinder Singh Rana confirmed to Legally India that the bar exam was postponed to 6 March. He added that 2010 graduates would not be permitted to practice until they passed the exam. However, another source said he was told by a state bar council BCI member that 2010 would be permitted to practice before passing the exam and that a press conference would be held at 16:00 tomorrow (12 November).
Gopal Subramanium confirmed to Legally India that he was absent from the meeting due to ill-health but was currently getting up to speed on the latest developments.
UPDATE 15 November, 13:19: The Times of India has also confirmed that the bar exam will be postponed.

The other question tht needs to be answered is wht is the BCI chairman refused to signs. Since the meeting had a quorum,would the resolution be binding on the BCI chairman.....
BCI is jus playing trick they neva had the infrastructure to conduct this exam...

As already suggested by Committee set up on "Legal Education", BCI should no longer interfere with the legal education in the country.

Whose duty was it to send the materials to the students? Was it Rainmaker's since they were organizing and conducting the exam? Kian, if you could specify this in the article so that we know exactly.

Times like these i'm glad i decided to take some time off after graduation, and then look for transactional work.
the students who have enrolled at the state bar council are at least called advocates rite?!!
since they have postpond the dates of bar council exam still the next year 6th march of 2011...sir but very few are in knowledge about this exam so many does not even know about this exam so if the last date for the application submission would postpond for few dates more it will be help full for the students to join bar council exam.... please make a note of my message sir...thanking you...anju
With all of this nonsense happening, I am surprised why our courts that pounce on interim orders haven't stayed this. At the present state of affairs, the SC should allow the writ petition and strike down this proposal.

i urge all my batchmates & colleagues to take a stand & do something that will shake these people out of their dream world & make them realize our plight..
2.Even if they pick up, they talk only in Hindi.
3.No email queries are answered properly.
4.Many have not got their Preparatory materials on time as promised (Think they are running out of papers).
5.They don’t stick with one Address to facilitate the enrolled lawyers to send their Applications.
6.They do not update the their website regularly, and we have to keep googling or check LegallyIndia or Barandbench for updates.
7.Already wasted whole 6 months and now another 3 making it 9 in total.
8.Failing our College exam would have been better.. Coz they make us wait only for a period of 3-4 months. And BCI is making us wait for more than 6 months.
9.I think this is more than enough to cancel the AIBE for the 2009-2010 Batch.
It is like insulting the Aspiring Advocates on their Face!!
Thanks for giving updated information and pls do us favour post our comments daily and make them to cancel the exam completely for this year, if they want let them conduct from next year. Why Rainmaker again, he is painmaker. BCI already wasted our time if they conduct the exam in March, 2011, who is going to compensate us, financially we are broken, if we wait for another 3 months it is absolutely waste of time. BCI must understand the position of young lawyers. We already enrolled and got the membership No. why should we write this such type of stupid exam. Let the BCI give prior intimation to the next batch students or else let them start with new fresh batch from this year. Any how thanks once again.

Mr. Gopal Subramaniam has no moral standing to remain Chairman of Bar Council of India.
A single person or few person with authority will decided and restrict us from profession for 10 months, give us compensation of a this 10 months at atleast RS.15,000/month.. then we are ready to sit back.. consider this Mr.SG and also SC.. and i may like to remind SC of its suo moto powers, but its useless i mean one who doesnt even allow to mention the matter will never give justice.

if u want to check the eligibility of advocates,are u sure the working advocates are eligible.why we are not and the main thing is money if u really want to check this it should be free why 1300rs.every timin these days every test has become money matter the fresher advo.are already struggling they have alreadry no work in the starting and now u people.they have to struggle along tine for income and u r looting them by taking test
