SC stays Allahabad’s super-diplomatic Ayodhya partition: ‘strange’

The Supreme Court has stayed the operation of the landmark September 2010 Allahabad high court’s Ayodhya judgement, which divided the disputed Ram Janmabhoomi-Babri Masjid site into three, calling it “something strange”.

The court said that the trifurcation of the disputed land in the absence of an explicit demand from the parties’ contesting the case was “strange”, reported PTI.

Justices Aftab Alam and R M Lodha presiding over the bench today ruled after the judgement was challenged in the apex court by one of the parties in November last year.

They directed that no religious activity should take place on the 67-acre land owned by the central government next to the purported temple/mosque and that the status quo would be maintained for the rest of the property, according to The Hindu.

“A new dimension was given by the high court as the decree of partition was not sought by the parties. It was not prayed by anyone. It has to be stayed. Its a strange order,” the bench said according to The Hindu. “How can a decree of partition be passed when none of the parties had prayed for it. Court has done something on its own. It’s strange. Such kind of decrees cannot be allowed to be in operation.”
