The Andhra Pradesh High Court, which from today will be called the High Court of Judicature at Hyderabad for the state of Telangana and the state of Andhra Pradesh, has enforced new rules for entry of litigants and advocates not practicing in it, reported the New Indian Express.

All outsiders can only enter its precincts after citing “proper reason” and showing a photo identity card, and in every document submitted to the court the new full name of the court has to be written.

Telangana and residuary Andhra Pradesh come into existence as two separate states today following the AP Reorganisation Act 2014, and this high court is the common high court for both.

The Andhra Pradesh high court has ordered the $3.2bn takeover to be stayed as "interim status quo" in a writ petition alleging insider trading, reported Bloomberg.

The writ petition was filed by a number of investors, seeking to force an insider trading investigation by the Securities and Exchange Board of India (SEBI).

Three Indian law firms, Amarchand, Luthra and Crawford Bayley, and two foreign firms are advising on the takeover.

Dowry case filed against AP HC judge: The daughter in law of an Andhra Pradesh high court judge has filed a case of dowry harassment against him. The judge, who has not been named in the report, allegedly made persistent demands for dowry from Kavya Rao's family after his son lost his job in 2008 [PTI]

Bombay, Karnataka and Andhra Pradesh high and subordinate courts will in real time upload their case pendency statistics and case progress reports online, with litigants slated to have access to some of the data via phone text messages. The deadline for these three states’ courts to implement the upgrade was June 2013, and for all the other HCs it is December 2013, according to a Times of India report citing sources.

This data will be on the National Judicial Data Grid (DJDG) which is part of the eCourts project, and is also supposed to assist in formulating policy to reduce case delays. The implementing agency, the National Informatics Centre, has reportedly provisioned 100 “virtual machines” at its national data centre (NDC) in New Delhi to host the flood of real-time data. Data from 17 district courts has already been uploaded by the HCs with the data centre.

The Supreme Court’s vacancies are set to come down to three again, as the names of Andhra Pradesh high court (HC) chief justice PC Ghose and Himachal Pradesh HC chief justice Kurien Joseph have been cleared for elevation to the SC roster by the collegium, a month after three new judges were sworn in.

According to the Hindu’s sources in the law ministry, the process of appointment of the two judges will be completed in around a month.

While Ghose (60) was appointed as chief justice only in December, Joseph (59) was heading the Himachal Pradesh high court since February 2010. Ghose first became a judge in 1997, while Joseph is a judge since 2000.

Ghose would have a tenure of around five years in the SC, while Joseph would preside for almost six years.

Madras HC judge S Nagappan has been cleared to be appointed chief justice of the Orissa HC. [The Hindu]

Nalsar Hyderabad will see another change of chancellor in less than a year as Ghose becomes the second Andhra Pradesh HC chief justice to be elevated after justice Madan B Lokur’s June elevation.

SC justice Swatanter Kumar retired in December 2012, and DK Jain retired in January 2013. However, justices MY Eqbal, Vikramjit Sen, and V Gopala Gowda were sworn in in January.

Supreme Court Breaking: Alleged proclaimed offender and Andhra Pradesh high court (HC) judge NV Ramana will continue as a judge in that HC, after the Supreme Court (SC) today dismissed the petition challenging his appointment and imposed costs on each of the petitioners.

Proclaimed offender and Andhra Pradesh High Court (AP HC) judge N Venkata Ramana may continue as judge even after his recommended removal by the Chief Justice of India, if the Parliament does not initiate his removal, attorney general GE Vahanvati told the Supreme Court.

An arson case was filed against Venkata Ramana prior to his appointment at the AP HC, and he was declared a proclaimed offender. A petitioner, through senior advocate Shanti Bhushan, approached the SC for quashing his appointment, in light of the pending criminal case against him.

Vahanvati told a bench of Justices Aftab Alam and Ranjana P Desai that once a Judge has been appointed, the parliament is the sole authority to initiate his removal as:

The Constitution makers were clear that Judges of higher judiciary needed to be protected to uphold the higher principle of judicial independence.

Removal is the only process recognized by the Constitution to maintain independence of judiciary. Hard cases and harsh facts involving a particular person make no difference to the higher principle.

Venkata Ramana’s name was dropped twice from being considered by the collegium of judges appointing high court justices. It was on erstwhile law minister Ram Jethmalani’s insistence that the collegium was persuaded to reconsider his name. [TOI]

Telangana Andhra Pradesh lawyers boycotted lower courts in Telangana to protest prosecution of 24 lawyers who had led an agitation in the High Court of Andhra Pradesh.

The 24 lawyers were agitating for a 42 per cent quota for Telangana advocates in the posts of government pleader, public prosecutor, and assistant public prosecutor.

The boycott encompassed lower courts in eight districts and the Secunderabad metropolitan courts, while there was slogan shouting in the high court premises and copies of the government order for prosecution of the lawyers were burnt. [The Hindu]
