CIC orders BCI to publish all past All India Bar Exam (AIBE) question papers online

"The Central Information Commission has directed the Bar Council of India to proactively post on its website the question papers and keys of the All India CIC Bar Examination for the benefit of young lawyers,” reported the PTI.

Information Commissioner Sridhar Acharyulu said:

It is reported that around 27000 young advocates could not clear this qualifying examination. Every year law universities and law departments of other universities will be rolling out thousands of young law graduates, who are expected to take this mandatory examination.

The Commission requires the Public Authority to collect the copy of question papers with key for first three years from the Rainmaker firm which conducted examination, and keep the same on official website for the use of young lawyers.

The PTI report added that “he asked the Bar Council of India to provide question papers along with the key on the official website immediately after completion of every Examination, which will avoid exploitation of young lawyers by commercial elements selling the question papers with key at exorbitant rates”.

The first three All India Bar Exams (AIBE) were conducted by contractor Rainmaker, with the BCI claiming that the company had not shared the first three AIBE question papers with the BCI The CIC said that if the BCI did not have access to previous papers, it should initiate legal action against Rainmaker to recover those papers.

The BCI’s AIBE contract, which is worth multiple crore Rupees and is heading into the eighth edition, with more than two months of delays, was later awarded to Noida-based company ITES Horizon Pvt Ltd.

Legally India understands that the original contract between the BCI and Rainmaker agreed to a joint copyright over preparatory materials, which was never resolved.

Legally India is currently in a long-running RTI process with the BCI to obtain meeting minutes and increase transparency of the BCI’s internal functioning.
