Cyber policy 2013: The government has released the National Cyber Security Policy 2013 aimed at protecting information and at building capabilities to prevent cyber attacks. The policy plans to set up a national nodal agency to co-ordinate all matters related to cyber security in the country with clearly defined roles and responsibilities. It plans to establish a mechanism for sharing information, identifying and responding to cyber security incidents and for cooperation in restoration efforts. “...(The) policy is a framework document and it gives you a broad outline of what our vision is... the real task or the challenge is the operationalisation of this policy,” IT minister Kapil Sibal said [Mint]

J&K wants SBC: Jammu & Kashmir (J&K) political party leader senior advocate Bhim Singh has filed in the Supreme Court to create a J&K state bar council, to end “discrimination against local lawyers”. “The Bar Council of J&K, though, forms part of the Bar Council of India (BCI), yet there is no elected body of lawyers in the state of J&K,” says his petition, adding that since 1986 the state bar council has been headed by the J&K Chief Justice with other HC judges as members [Zee News]

Contemptuous rape arrest: Four days after a judicial magistrate was arrested on a rape complaint by a woman sub-inspector of police, the Madras high court has initiated suo motu contempt proceedings against the woman superintendent of police and four of her subordinates. “Blatant misuse of powers and showing scant regard and disrespect to the guidelines issued by the Supreme Court, have compelled us to take a suo motu action for contempt by five police officers and three constables,” the first bench comprising acting Chief Justice R K Agrawal and Justice M Sathyanarayanan said [TOI]

Un-fair courts: Out of 650 HC judges in India only 52 are women, while out of 29 SC judges only two are women. Former SC justice Ruma Pal was the third woman judge ever to reach the SC, she retired in 2006 narrowly missing being made the first woman Chief Justice of India by a day’s margin. The Calcutta HC has had only 10 women judges in the last 150 years. CJI-designate Justice P Sathasivam commented that “seniority could be compromised to promote elevation of women to the higher judiciary” [HT]

Madras bar strikes (again): Various Tamil Nadu Bar associations including the Tamil Nadu Advocates Association (TNAA), the Madras High Court Advocates Association (MHAA) and the Women Lawyers Association have announced a one-day token boycott of all courts and tribunals on Tuesday. The advocate community in the state “felt threatened” after at least half a dozen advocates were arrested in various parts of the state and nearly 40 advocates were included in fresh cases. Bar leaders demanded the immediate release of all the arrested lawyers, besides protection for other lawyers from arrests [TOI]

Pendency: Over 67,000 Supreme Court cases were in arrears on 31 May 2013, with 18,350 one–year old matters, 61.4 per cent briefs stuck in the registry due to incomplete formalities, 45 out of the ready-to-hear matters awaiting constitution benches (5 or more judges), 140 cases referred to larger benches. The judges to people ratio in India is 10 judges for 1 million people, while the law commission recommended ratio is 50 to 1 million [BS]
