Verus wins in meat ban again: SC preaches 'tolerance and accommodation', declines to interfere [UPDATE-1]

The Supreme Court today declined to interfere with the Bombay high court which had stayed the order of the Municipal Corporation of Greater Mumbai prohibiting the sale of meat during the Jain festival of Paryurshan.

An apex court bench of Justice TS Thakur and Justice Kurian Joseph, while refusing to entertain the plea by a trust, said that there should be a spirit of “tolerance and accommodation”.

The court allowed the petitioner Shree Tapagachiya Atma Kamal Labhdisuriswarji Gyanmandir Trust to go to the high court to raise all the contentions and plea for an early hearing.

Update: Verus Advocates partners Krishnayan Sen, Charles De Souza and Mahima Sinha, instructing counsel Zubin Behramkamdin, represented the first respondent, the Bombay Mutton Deal Association, as they had in the Bombay high court.

Sen commented: “It’s significant that the Supreme Court refused to intervene in the matter. The ban purported to infringe upon citizens’ basic civil liberties and freedom of choice - which can’t be permitted - even if it’s just for a day. We intend to argue the matter at length before the High Court as and when the matter is taken up next.”

The trust has challenged September 14, 2015, interim order of Bombay high court.
