Police on Monday filed a voluminous charge sheet, invoking the dreaded charge of 'culpable homicide not amounting to murder' against 35-year-old corporate lawyer Jahnvi Gadkar, who was arrested on June 10 for drunk driving and killing two people.
Running into around 560 pages, the charge sheet includes statements of 57 witnesses, besides the 14 witnesses whose statements have already been recorded by a court.
Filed before the Kurla metropolitan magistrate's court, the charge sheet also contains Gadkar's medical reports, autopsy reports of the victims, forensic reports, CCTV footage details, statements of doctors and her friends, besides other evidence.
Among others, Gadkar has been charged under Indian Penal Code section 304 II (culpable homicide not amounting to murder, attracting a maximum punishment of 10 years in jail -- the same section slapped on Bollywood actor Salman Khan for which he was sentenced to five years in prison -- plus other sections of the Motor Vehicles Act.
Gadkar, who was released on bail on August 5 by the Mumbai Sessions Court, was present in the court on Monday.
In the early morning of June 10, Gadkar's speeding car, on the wrong side of the Mumbai Eastern Freeway, rammed into a taxi killing its driver Mohammed A Sayyed and his passenger Mohammed S Sabuwala, and injuring four other people.
The ill-fated cab was coming from Bhiwandi in adjoining Thane district.
Among the injured members of the Sabuwala family were wife Hafiza, 40, daughter Salma, 22, Sadia, 20 and son Noman, 16, who were returning home after celebrating Numan's success in the SSC exams in which he scored over 90 percent marks.

Just because she is a lawyer, with a similar lived-experience as us or as some of us desire in near future, a number of people out here try to drum up opinion in her favor. She was wantonly reckless and people lost lives as a result, she made a choice and should have to pay for it as per law.

Personally anyone with such little regard for HUMAN life needs to be locked up. I do not want to travel on a road that I know a Jahnavi Gadkar may be driving on. As a lawyer and human being, just beyond disgusted!

If Janhavi gets anything less than 5 years, it will mean she got the benefit of being drunk, or being a lady, or a high profile lawyer.

Corporate lawyer Janhavi Gadkar, who was arrested for mowing down 2 people here allegedly under the influence of alcohol, has moved a suburban Kurla Magistrate court challenging the applicability of the charge of culpable homicide not amounting to murder against her.
In her plea, she said that her case should not be transferred to the sessions court for trial.
She has argued that charge of section 304 II of Indian Penal Code (culpable homicide not amounting to murder) is not applicable against her and the police have not made any case for applying the charge.
Gadkar, 35, has informed the court that she did not have any intention to kill anybody nor she knew that this accident would happen.
The court is likely to hear the application tomorrow.
In the wee hours of June 10, an high-end car driven by Gadkar had rammed a taxi, killing two persons including the taxi driver on the Eastern Freeway here.
The deceased were identified as Mohammed Abdul Sayyad (55) and Mohammed Salim Sabuwala (50).

I don't see why RTO took such a long time to even cancel her licence. Technically she was allowed to drive after she got bail until this decision to cancel her license.
