SCBA finds judge was 'prima facie' sexually harassed by other, wants FIR filed, offers all assistance

The Supreme Court Bar Association (SCBA) executive commitee is “prima facie of the view” that a female additional district judge in Gwalior was sexually harassed by a more senior judge, and that this complaint should be dealt with immediately by the CJI.

The SCBA also urged the CJI to file an FIR and to take other “departmental” action against the judge, according to a resolution passed at the SCBA’s meeting, which stated:

The Executive Commitee has perused the letter dated 5th August 2014 addressed by the former ADJ, Gwalior and the resolution-cum-proposal of the Ladies Bar Room / Welfare & Grievance of Women Lawyers Sub-Committee meeting dated 5.8.2014.

The Executive Commitee of the SCBA is prima facie of the view that this amounts to sexual harassment and needs to be thoroughly and efficaciously probed. The Committee is very much disturbed and anguished by the statements contained in her representation.

The Executive Committee resolves to recommend to Hon’ble the Chief Justice of India (sic) requesting him to take immediate action both departmental as well as directing filing of FIR. A proper and effective action ought to be taken.

The SCBA will render all assistance which she requires to pursue her representation or follow up action before the Court or before any other authority.

CJI RM Lodha has promised to investigate the complaint quickly after it came to media attention in early August.

When two allegations of sexual harassment were made by former interns against former Supreme Court judges less than a year ago, the SCBA is not believed to have passed any resolution in support of the complainants.
